This ordinance shall establish a new chapter in the Code of the Borough of River Edge. Said chapter shall be Number 206 and shall begin on page 206:1 of the Code of the Borough of River Edge. This Chapter 206, starting on page 206:1, shall include the listing of all fees and charges for permits, licenses and applications, which listing was kept on file with the Borough Clerk at the time of legal adoption of Ordinance No. 1172.[1]

Minimum fee. The minimum fee for a basic construction permit covering any or all of building, plumbing, electrical, elevator or fire protection work shall be $75 for Use Groups R-3, R-4 and R-5. The minimum fee for all subcodes for all other use groups shall be $100. All fees shall be rounded to the nearest dollar amount.

(8) 
Plan review. The fee shall be 20% of the amount to be charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit. This fee is not refundable.
(9) 
Miscellaneous. The fee for a construction permit for any item requiring a construction permit not specifically addressed shall be $60 unless otherwise specifically set by other subcode or municipal ordinance.
(10) 
Training fee. In order to provide training, certification and technical support programs required by the Uniform Construction Code Act[4] and the regulations promulgated thereunder, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee as per N.J.A.C. 5:23-4.19(b). Said surcharge fee shall be remitted to the Construction Code Element, Division of Housing and Development, Department of Community Affairs, on a regular quarterly basis.

Annual permits. The fee to be charged for an annual construction permit shall be charged annually. This fee shall be a flat fee based upon the number of maintenance workers who are employed by the facility and who are primarily engaged in work that is governed by a subcode. Managers, engineers and clericals shall not be considered maintenance workers for the purpose of establishing the annual construction permit fee. Annual permits may be issued for building, fire protection, electrical and plumbing. Fees shall be as follows:
(a) 
Fee per worker:

Prior to the issuance of an annual permit, a training registration fee of $100 per subcode shall be submitted by the applicant to the municipal construction official, who shall forward the fee to the Department of Community Affairs, Construction Code Element, Bureau of Technical Services, along with copies of the construction permit (Form 170). Checks shall be made payable to the "Treasurer, State of New Jersey."
(12) 
Fee schedule revision. The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Borough Council, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the New Jersey State Uniform Construction Code Act.
(13) 
Private on-site inspection and plan review agencies. Private on-site inspection and review agency under contract shall comply with the regulations and fees pursuant to N.J.A.C. 5:23 et seq.
(14) 
Administrative surcharge. A surcharge fee of 15% shall be added to each subcode fee in which plan review and inspections are performed by an on-site agency under contract with the municipality.
J. 
Public Defender application fee: up to $200 (per P.L. 1997, c. 256, N.J.S.A. 2B:24-1 et seq.). The fee, in whole or part, is waivable by the Judge of the Municipal Court.

(1) 
Application fee (minimum fee): $500 (plus $1 per linear foot over 100 linear feet).
(a) 
Fee for failure to apply for a road opening permit shall be a fine not exceeding $1,000 (twenty-four-hour grace period for emergency road opening).
(2) 
Inspection fee (minimum fee): $500 (includes up to two inspections of a maximum duration of one hour each (any additional inspections thereafter shall be paid at the rate of $150 per hour, one hour minimum).

Performance escrow (refundable): In the form of cash or an approved surety bond in the amount of $1,500 (bituminous concrete roads) or $3,600 (concrete roads, granite, concrete pavers or historical street), provided that the estimated dimensions of the opening are 120 square feet or less, and in the amount of $1,500 (for bituminous concrete roads) or $3,600 (concrete roads, granite, concrete pavers or historical street) plus $15 (bituminous concrete roads) or $30 (concrete roads, granite, concrete pavers or historical street) per square foot for each square foot of openings estimated to exceed 120 square feet.

Municipal Court discovery. The following fees shall be payable by the requestor to the Borough of River Edge for requested discovery in matters pending in the River Edge Municipal Court:[11]

The fee assessed for discovery embodied in the form of printed matter shall be $0.05 per letter-size page or smaller, and $0.07 per legal-size page or larger.

(i) 
The Recreation Director shall prepare a report at the end of each season providing details of each program including the number of participants, the revenue collected, and the amount that is payable to the dedicated trust fund. This report shall be presented to the Recreation Commission for their review. Upon a satisfactory report, transfer of the $20 per participant fee to the dedicated trust fund shall be done by resolution of the Recreation Commission and provided to the Finance Office.
(j) 
A $10 discount may be deducted from men's softball and women's badminton registration fees when registering for both Spring and Fall seasons at the same time upon recommendation of the Recreation Director and approval by the Recreation Commission and Mayor and Council.
(k) 
To be eligible to be a Borough-sponsored program, recommendation of the Recreation Director with approval by the Recreation Commission and Mayor and Council is required.

Fees for for-profit's weekly camp and/or clinic programs shall be $750 for up to 25 hours of use or portion thereof for each camp or clinic program (hours must be used within five consecutive days).
(e) 
100% of the fee minus a $25 administrative fee shall be refunded for cancellation requests made in writing to the Recreation Director up to 14 days' prior to the start date of the program.
(f) 
No refunds shall be given for cancellation requests made within 13 days of the start date of the program.
(g) 
The fees, dates, and eligibility terms will be set annually by resolution of the Mayor and Council as recommended by the Director of Recreation and Cultural Affairs.
(h) 
Non-River Edge organizations are defined as organizations whose primary address is not based within the geographical boundaries of River Edge and/or whose members do not exclusively reside within River Edge. Membership rosters and proof of residency shall be required.
(i) 
Use of River Edge recreational facilities by non-River Edge organizations shall be recommended by the Recreation Director with approval by the Recreation Commission and the Mayor and Council.
(7) 
Use of recreational fields and facilities by the Borough of River Edge, Borough of River Edge, the River Edge Recreation Commission or the Central Athletic Council Leagues:
(a) 
Programs within this category shall contribute $20 per participant per program and per season, unless exempted, to a dedicated trust fund to be used towards maintenance and improvements of Borough of River Edge owned recreational facilities and/or towards lighting costs of Borough owned recreational facilities or towards the costs of secondary insurance policies for these programs.
(b) 
The fee for programs within this category shall take effect on January 1, 2024 and remain in effect through December 31, 2024. Thereafter, the fee shall be set annually by resolution of the Mayor and Council as recommended by the Recreation Director.
(8) 
Sponsorship:
(a) 
A sponsor may offer monetary or other acceptable material support to any authorized Borough program or related activity. This may include, but not necessarily be limited to, providing financial support to a Borough recreation program, activity or facility improvement or modification that provides a public benefit, subject to any applicable laws, ordinances and authorization by the governing body or Borough Administrator. Sponsors shall be entitled to recognition or acknowledgment by way of public address, approved signage, written announcements, correspondence or other appropriate means, subject to the following standard terms and conditions:

All sponsorship proposals equal to or less than $5,000, including creation of sublevels may be set and approved by the Borough Administrator. Proposals in excess of $5,000 in material value are required to be approved by the governing body upon the recommendation of the Borough Administrator.

No program participant, Borough employee or official shall be required to participate in surveys or focus groups as a condition of any such sponsorship.
[3] 
Such recognition in any manner shall not constitute the Borough's endorsement of any product, service or program provided by the sponsor.
[4] 
All sponsorships shall be appropriate for audiences of all ages and shall not promote any illegal or discriminatory activity.
