No business shall be open to the public between the hours of 12:00 midnight and 6:00 a.m. within the Borough of Riverdale.
The following businesses shall be exempt from the limitation on hours of operation contained in this chapter.
A. 
Restaurants.
B. 
Bars.
C. 
All businesses which were open to the public between the hours of 12:00 midnight and 6:00 a.m. prior to January 1, 2000.
Any business desiring to operate between the hours of 12:00 midnight and 6:00 a.m. may apply to the Mayor and Council for a waiver of the limitation on hours of operation contained in this chapter. The Mayor and Council may grant a waiver of the limitation on hours of operation if they find that the business can be open between the hours of 12:00 midnight and 6:00 a.m. without disrupting the peace and tranquility or compromising the public safety of the Borough. The waiver shall be obtained on a yearly basis by the business. Upon approval by the Mayor and Council, the business shall pay an annual fee of $0.01 per square foot with a minimum fee of $25 to defray municipal expenses.
