A.
PERSON
RIDING ACADEMY or CARRYING ON THE BUSINESS OF A RIDING ACADEMY
Terms defined. As used in this chapter, the following
terms shall have the meanings indicated:
Includes natural persons, firms, partnerships, associations and corporations.
Includes any barn, building, enclosure or other place of business,
the principal use of which is to stable and keep, or to let out for hire,
horses for riding purposes.
B.
Word usage. Pronouns of the masculine gender, when used,
shall be construed to include both the feminine and the neuter.
No person shall keep, conduct, operate or maintain a riding academy
hereafter within the Borough of Riverdale without first obtaining a license
to do so, in the manner herein provided.
Any person desiring to keep, conduct, maintain or operate a riding academy,
or carry on the business of a riding academy, shall make application in writing
to the Borough of Riverdale, setting forth the name of the applicant, his
place of business and residence, and the number and description of the horses
to be stabled and/or used in such business.
A.
If the application be approved by the Borough, the Borough
Clerk shall thereupon issue a license upon the payment to him of the fee therefor
hereby fixed for such business. Every license shall expire on December 31
of the year of its issue, and shall apply only to the person or persons to
whom such license is granted and shall not be transferable.
B.
A license may be refused by the Borough if the place
from which said business is to be conducted is found to be unsuitable from
consideration of public health, safety and welfare, or in violation of the
building or zoning or other ordinances now or hereafter adopted.
C.
Any license issued hereunder may be revoked upon notice
to the holders thereof for any reason deemed sufficient for refusal to grant
such license or for the habitual failure of the licensee to obey the requirements
hereof or any other reasonable regulations in connection with the operation
of such business which the Borough may require.
D.
All riding academies and other similar businesses, the
premises occupied by them and records required to be kept under this chapter
shall be open to inspection by the proper officers of the Fire, Police and
Health Departments of the Borough of Riverdale, at all reasonable hours of
the day or night.
A.
The license fee under this chapter shall be as follows:
(1)
There shall be a minimum license fee for each place,
stable or establishment of $300 for which said person or persons operating
such place or establishment is entitled to have a maximum of five horses.
(2)
For each and every horse that such licensee has in excess
of five horses, he shall pay an additional license fee of $50 for each and
every horse.
Any person to whom such license is granted as herein provided is hereby
required to exhibit such license whenever called upon to do so.
Every person riding a horse on any street, road or highway in the Borough
of Riverdale shall observe traffic rules and regulations applicable thereto,
turn only at intersections, signal all turns, ride to the right-hand side
of such street, road or highway, pass to the rider's left when overtaking
or passing vehicles, persons or other riders stationary or slower in motion,
and pass to the rider's right when meeting approaching traffic.
Riders shall not ride more than two abreast and shall at all times so
govern and control their horses as not to unnecessarily interfere with other
riders or traffic.
No person or persons shall at any time race one horse against another
on any street, road or highway, nor ride at an excessive, careless or dangerous
speed.
No person shall halt, interfere with or forcibly stop, without good
cause, any horse being ridden upon any street, road or highway.
No person shall throw any stone, stick, other missile or substance at
any horse or its rider; nor shall any person strike or strike at such horse
in such manner as to startle, alarm or frighten it, so as to endanger the
safety of the rider or any other person.
No person shall manipulate any automobile, power or horse propelled
cart, truck or other mechanical device, or by causing any unnecessarily loud
or sudden noise, startle, alarm or frighten any horse being ridden upon any
such street, road or highway, thus endangering the rider or any other person.
No person shall cause or permit any horse or horses to run at large
in the Borough of Riverdale, and the owner of any horse or horses running
at large on any public or private property within the Borough without the
consent of the owner thereof shall be deemed guilty of an unlawful trespass
upon such property. Any horse or horses running at large within the Borough
shall be impounded by the Chief of Police, and the cost of their care and
maintenance during the time they are impounded shall be paid by the owner
thereof before their release, and in default of such payment such horse or
horses shall be sold by the Borough to satisfy its claim for such expense.

Any person or persons violating this chapter, or any section thereof,
shall, upon conviction thereof, forfeit and pay a fine not exceeding $1,000
or shall be incarcerated in the county jail not exceeding 90 days for each
and every offense and each and every day that an offense exists, persists
or is committed shall constitute a new and separate offense.
