The following enforcement provisions shall be established for all site
plans and resolutions of approval granted by the Planning Board and/or Zoning
Board of Adjustment of the Borough of Riverdale.
The Zoning Officials and Deputy Zoning Officials of the Borough of Riverdale
shall be empowered to issue summons and enforce any approved site plan and/or
resolution.
Violation of site plan and/or resolutions shall be enforced as follows:
A.
The Zoning Officer and/or Deputy Zoning Officer shall
issue a notice of abatement listing the violations of the site plan and/or
resolution.
B.
The notice of abatement shall specify the date by which
the violation shall be corrected. The term of abatement shall not be in excess
of 60 days, unless the Zoning Official grants an extension.
C.
Failure to abate the violation shall result in the issuance
of a violation summons.
D.
The fine for violation shall be no less than $100 per
day from the date of the summons to correction, to no more than a $1,000 per
day.
E.
In the event that the violation has not been corrected
within 60 days of a judicial determination of violation, the fines shall be
increased to no less than $500 per day, until said violation has been abated.
The Court may abate imposition of any fines for a period of 30 days
upon proof the correction has been undertaken.
In the event the violation continues the minimum fine shall increase
by 100% every 60 days until abated.
Jurisdiction for enforcement and determination of violation and fines
is hereby vested in the Municipal Court of the Borough of Riverdale.
