The words, terms or phrases listed below, for
the purpose of this article, shall be defined as follows:
Any pool used and maintained for swimming purposes by an
individual for use by his household and guests and located on a lot
as an accessory use to a residence. Both artificial and partly artificial
pools shall be included. "Partly artificial pools" shall mean pools
formed from a natural body of water so limited in flow that the quality
or quantity of the water must be maintained by artificial means.
Any pool used and maintained by an individual, firm, corporation,
club or association of persons for use by the public or club members
and their invitees and guests.
A pool not designed or used for swimming and installed below
ground level, with a maximum area of 120 square feet and a maximum
depth of 24 inches.
It shall be unlawful to construct or establish
a private swimming pool, wading pool or public swimming pool, as herein
defined, without having obtained a permit therefor in the manner hereinafter
described.

Application for a permit for the construction
of a swimming pool or wading pool shall be made to the Building Inspector.
Each application shall be accompanied by duplicate sets of plans,
specifications and plot plans of the property. The location of the
pool on the property shall be shown, together with the location, height
and type of fencing or walls and accessory buildings. No permit shall
be issued until the plans, specifications and plot plan have been
approved by the Building Inspector and approval has been certified
on said plans. The Borough Council may from time to time by resolution
establish the amount of the fee for a swimming pool permit and a wading
pool permit.[1]

The construction and design of such pools shall
be such that the same may be maintained and operated as to be clean
and sanitary at all times. The owner of every such pool shall be responsible
to maintain said pool in such condition as to prevent breaks in the
pool chassis or water from the pool overflowing into adjacent public
or private property. Sand or earth bottoms shall not be used. Public
swimming pools shall be constructed, equipped and maintained in strict
conformity with the currently published provisions of the Swimming
Pool Code issued by the State Board of Health.
There shall be no connection between a potable
public or private water supply system and a pool at a point below
the maximum flow line of the pool. No pool water shall be discharged
or siphoned into a potable water supply system.

Each swimming pool and wading pool, as herein
defined, shall be provided with one drain pipe which shall not be
over two inches in diameter. Such drain pipe shall provide drainage
from such pool to the property of the owner or to a storm sewer or
stream.

No pool, including enclosures and accessory
buildings hereafter constructed, shall be located nearer to any street
line on which the pool property abuts than the established building
line on said street, nor shall the same be located nearer than 10
feet to any abutting line.
No artificial lighting shall be installed, maintained
or operated in such a manner as to be a nuisance or annoyance to neighboring
property.

A permanent barrier or obstruction not less
than four feet nor more than five feet in height shall be constructed
in such a manner as to entirely enclose the area in which the swimming
pool or wading pool is located and to bar all reasonable and normal
access to such pools, except through a substantially self-closing
gate or gates of a height of at least four feet but not exceeding
five feet, equipped with facilities for locking said gate or gates
when the pool is unattended or unguarded.

The owner and operator of every swimming pool
or wading pool constructed in the Borough of Riverton shall at all
times comply with the provisions of this article and with the requirements
of the health authorities. The provisions of this chapter shall be
enforced by the Zoning Officer, Construction Code Official, Board
of Health or such other duly authorized Borough authority.
Any person violating this article shall be subject
to a fine not to exceed $50 and, upon default in the payment thereof,
may be imprisoned for a term not to exceed 10 days. Every day that
such violation continues shall constitute a separate offense.
