[Adopted 9-8-1983 by Ord. No. 11-83]
Pools used for swimming or bathing shall be in conformity with the requirements of this article; provided, however, that these regulations shall not be applicable to any such pool less than 24 inches deep or having a surface area less than 250 square feet, except when such pools are permanently equipped with a water recirculating system or involve structural materials. For purposes of this article, pools are classified as private swimming pools or public and semipublic swimming pools, as defined below.
A.
Any constructed pool which is used or intended to be used as a swimming pool in connection with a single-family residence and available only to the family of the householder and his private guests shall be classified as a private swimming pool.
B.
Any swimming pool other than a private swimming pool shall be classified as a public or semipublic swimming pool.
A.
From property lines. The edge of such swimming pool shall be a minimum distance of 10 feet from any property line and a minimum distance of three feet from any fence.
B.
From structures.
(1)
Aboveground pools. No aboveground swimming pool shall be placed or constructed within six feet of the foundation wall of the residence.
(2)
In-ground pools. In-ground pools shall be constructed in such a way that the distance from the inside face of the pool at the water line to the outside face of any foundation walls shall be not less than the following:
(a)
Slab on grade foundation walls: six feet.
(b)
Basement and crawl space foundation walls: 1 1/2 times the depth of that portion of the pool adjacent to the foundation wall but not less than six feet. The land contour at the foundation wall must be higher than at the pool to ensure drainage away from the foundation walls.
Every swimming pool constructed prior to the adoption of this article shall, within 30 days from the adoption of this article, and every swimming pool hereafter constructed shall, prior to completion of construction, be completely surrounded by a fence or wall of suitable construction of not less than four feet in height which shall be constructed so as not to have openings or holes or gaps larger than two inches in dimension, except for doors and gates; and if a picket fence is erected or maintained, the space between pickets shall not exceed two inches. A dwelling house or accessory building may be used as part of such enclosure. Said fence or wall enclosure shall be designed and constructed as to reasonably prevent any person from gaining access beneath, through or over the same and shall be provided with one or more substantial gates or doors of the same height as the fence or wall enclosure. Every gate or door shall be securely closed and said gate or door shall be locked so as to prevent unauthorized access to the pool. A natural barrier, hedge, pool cover or other protective device approved by the governing body may be used so long as the degree of protection afforded by the enclosure, gate and latch described herein is maintained.
No swimming pool shall be hereafter constructed without a permit. Applications for such a permit, accompanied by four sets of plans and specifications or proper descriptive brochure, shall be made to the Zoning Officer. The Zoning Officer shall not pass on the structural features or durability of the pool but shall issue a permit for the construction or installation of the pool if the plans and specifications or descriptive brochure complies with the rules and regulations hereinafter set forth. In the event that the Board of Health shall formulate rules and regulations designed for the control of such pools, the Zoning Officer shall not issue a permit until approval has been received from the Board of Health. The swimming pool permit is not a substitute or replacement for a building permit. Any pool construction which comes under the Building Code shall continue to require a building permit.
A.

B.
It shall be permissible for a person to utilize the storm sewer facilities of the Borough of Riverton for the purpose of draining privately owned swimming pools, provided that such drainage shall be accomplished directly into the storm sewer facilities and not involve the spilling or dumping of water upon the streets and highways of the Borough of Riverton.
No artificial lighting shall be installed, maintained or operated in such a manner as to be a nuisance or annoyance to neighboring property.
All pools shall be equipped with a ground fault interrupter device.
