The following definitions shall apply to this
chapter:
Individuals residing in the City of Somers Point who are
non-paid members of the Volunteer Fire Department or Rescue Squad
and who meet the definition of active member (or exempt member) as
established by the bylaws of the volunteer organizations as are in
effect on the effective date of this chapter.
Such charges, limited to those listed below, which are charged
and fully retained by the City of Somers Point as revenue. Specifically
excluded are any portion of the charges collected by the City on behalf
of another entity, including but not limited to the state, county,
or an outside vender.
The Fire Department or Rescue Squad of the City of Somers
Point.
All active volunteer members of the City of
Somers Point Fire Department or Rescue Squad as defined above shall
be entitled to the following incentive exemption of fees:
A.
Exemption from the municipal portion of the Uniform
Construction Code fee charged for the issuance of a building permit
required in connection with either the construction of a new single-family
home or an addition or repairs to an existing single-family home.
Said fee exemption is not to exceed $500 in any calendar year, and
the dwelling must be owned and occupied by the active volunteer member.[1]
A.
On or about January 1 of each calendar year, the City
Fire Chief and Rescue Squad Chief shall submit to the City Clerk a
list of all non-paid individuals who meet the definition for active
member/exempt member status, updated to add those individuals who
have completed their probationary period or to delete individuals
who have been dropped from membership or who no longer meet the criteria
for active member/exempt member status.
B.
All active volunteer members (and their families,
where applicable), must comply with all registration procedures and
complete all application forms established by the City of Somers Point.
No exemption shall be allowed for the following
fee charges:
A.
Fees, licenses and permits associated with any for-profit
activity.
B.
Fees and escrows required by either the Planning Board
or Board of Adjustment in connection with any site plan or subdivision
application.
C.
Escrows associated with engineering inspections.
D.
Posting of performance guarantee where required or
permitted by law.

A Length of Service Awards Program, hereinafter
referred to as "LOSAP," is herewith created in accordance with Chapter
388 of the Laws of 1997, to reward members of the Somers Point Volunteer
Fire Department and the Somers Point Volunteer Rescue Squad for their
loyal, diligent, and lengthy services to the residents of the City
of Somers Point.
The LOSAP shall provide for fixed annual contributions
to a deferred income account for each volunteer member who meets the
criteria set forth below; that such contributions shall be made in
accordance with a plan that shall be established by the City of Somers
Point pursuant to P.L. 1997, c. 388; and that such plan shall be administered
in accordance with the laws of the State of New Jersey, the United
States Internal Revenue Code, and this article.
The LOSAP shall provide for contributions to
each eligible member that meets the criteria as follows:
A.
Each active volunteer who would be eligible for LOSAP
shall accumulate at least 400 points, on an activity schedule to be
developed by the officers of the Somers Point Volunteer Fire Department
and the Somers Point Volunteer Rescue Squad and approved by the Somers
Point City Council. (See Schedules A and B attached.[1])

B.
Numerical weighting of the activity schedules requires
the expertise of the officers of the Somers Point Volunteer Fire Department
and the Somers Point Volunteer Rescue Squad with the approval of the
City Council of the City of Somers Point. (See Schedules A and B attached.[2])

C.
Schedules A and B shall be designed in a manner that
will allow the volunteer to be eligible for LOSAP if said volunteer
reached the minimum requirements and overall total of 400 points.
A.
The City of Somers Point's annual contribution shall
be $800 per eligible volunteer.
B.
The annual contribution shall be adjusted upon the
completion of every five years, rounded to the nearest dollar, in
accordance with the allowable consumer price index factor as set forth
in N.J.S.A. 40A:14-185(f).
Five years of service are required in order
for each member to become vested in the LOSAP.
The proposed estimated cost of this program
will be $48,000 in the first year and has been calculated as follows:
