No person shall conduct a circus, fair, carnival, rodeo or similar public
exhibition within the township without having first obtained a license and
paid the required license fee.
The fee for a license under this chapter shall be $25 for each day the
activity is to be conducted. Religious, charitable, fraternal and similar
nonprofit organizations conducting activities licensed by this chapter in
order to raise money for charity or some other public purpose or for the entertainment
or recreation of the residents of the township shall not be required to pay
any fee, but shall comply with all other provisions of this chapter.
In addition to general data required, an application for a license under
this chapter shall contain the following information:
A.
The date or dates and the hours during which the licensed
activity will be conducted.
B.
A list of all the games, attractions, contents or performances
that will be included in the activity to be conducted, a general description
of each and, if not operated by the licensee or his employees, the name and
address of the concessionaire or other person operating them.
C.
A description of the off-street parking and sanitary
facilities available at the location at which the activity is to be conducted.
D.
Appropriate evidence that the licensee has made adequate
provision for the payment of workmen's compensation to any of his employees
who may be injured as required by N.J.S.A. 34:15-71.
In addition to all other investigations required, the premises at which
the licensed activity is to be conducted shall be inspected by the Chief of
Police or a police officer designated by him to determine if there is adequate
off-street parking available and that the licensed activity can be conducted
without undue interference with vehicular or pedestrian traffic on public
streets. The application shall also be investigated by the Building Inspector
and a representative of the Board of Health to determine if the licensed activity
can be conducted without endangering public health or safety. All such officials
shall report the results of their investigations to the Township Clerk within
14 days.
Upon receiving the results of the investigations, the Township Clerk
shall transmit them, together with the information contained in the application
for the license, to the Township Committee. The Township Committee shall approve
or disapprove the application within a reasonable time. Upon the approval
of the Township Committee and payment of the required licensed fee, the Clerk
shall immediately issue the license. The license shall be valid only on the
date or dates and during the hours set forth in the application.
