Hazardous materials — See Ch. 101.
The following terms shall have the following meanings as used in this chapter:
GEOLOGIC HAZARDS
Solution channels, collapse sinkholes, subsidence sinkholes, disappearing streams, closed depressions and caves.
Geologic hazards may exist in developments which received approvals prior to the adoption of this chapter regulating development in limestone areas. Those hazards may be discovered during or after construction. In such cases it shall be unlawful for the developer and/or the owner to continue construction activities which would impact the geologic hazard until the following have occurred:
A. 
The occurrence of the hazard has been reported to the Township Clerk and Engineer within 24 hours of discovery.
B. 
A report on the geologic hazard which analyzes the impact of the hazard and details a remediation plan has been prepared and submitted to the township for review and approval by the Township Geotechnical Consultant (TGC).
C. 
After obtaining approval of the remediation plan from the municipality, necessary remediation of the hazard to prevent or minimize damage to buildings, structures, utilities, driveways, parking areas, roadways and other site improvements and to minimize pollution of the groundwater has been performed.
D. 
Any damage to improvements has been repaired and restoration of ground cover and landscaping has been accomplished.
E. 
The township has been reimbursed for the cost of inspection or other costs incurred in connection with the geologic hazard.
The Township Construction Official, the Township Engineer and any other duly authorized official of the Township of Washington shall be authorized to enforce the terms of this chapter.
Failure to comply with the requirements of this chapter shall subject a person to the penalties set forth in Chapter 1, General Provisions, § 1-3, General penalty, and shall in addition result in the imposition of a stop work order and/or the suspension of any building permit issued for the property in question.
