The Borough of Moosic shall, from time to time, send a notice for the demand for payment in the amount of the delinquent monies owed for the use of the sanitary sewers, including both delinquent charges owed to the Borough of Moosic, to the owners of record of the premises where such sewage originates.
Said notice or demand of payment shall state the total amount of money owed, together with the notice for said delinquent account may be paid. Said demand for payment shall also contain a notice that if said account is not paid within a period of 30 days from the date of the notice, then the Borough, in addition to any other legal remedies it may have, shall notify the appropriate water company to disconnect and terminate all water service to the realty where there are outstanding delinquent sewage charges.
In addition to the charges for the use of sanitary sewers, the Borough shall add a charge to cover the costs of the notice in the amount of $10 to advertise said cost, including postage, in addition to any other costs incurred.
The notice or demand for payment maybe amended by the Borough by motion at any time.
In the event that said delinquent sanitary sewer user fee, with all costs, penalty and interest incurred, is not paid within the period of 30 days, the water service in aforesaid premises shall be disconnected and terminated until said bill, penalty, interest and all other costs incurred are paid in full.
In the event it is necessary to disconnect and terminate the water service to the realty, an amount equal to the fee charged by the water company to disconnect the service and the fee to commence water service shall be added to the delinquent account and shall be payable in the same manner as the rates and charges.
Upon payment of the sanitary sewer user fee, penalty, interest and all other costs incurred, including the disconnect and reconnect charges, water service may be reinstated.
The termination of water service shall be made in accordance with the laws of the Commonwealth of Pennsylvania, the rules and regulations of the Public Utility Commission of the Commonwealth of Pennsylvania and all other applicable regulations.
The appropriate officials of the Borough of Moosic are authorized to enter into any contract with the company and/or corporation providing water service to the Borough of Moosic for the purpose of effectuating this article.

This article shall be known as the "Groundwater Non-Use Ordinance."
The purpose of this article is to prohibit the use of groundwater for potable and agricultural use within the Borough of Moosic.

The installation and use of supply wells and springs for potable and agricultural use within the Borough of Moosic are prohibited.
Any person who violates or permits a violation of this article, upon being convicted before a District Justice, shall pay a fine not exceeding $1,000, and any costs incurred by the Borough of Moosic, and in default of payment of the fines and costs shall be subject to imprisonment in the Borough jail for a period not exceeding 30 days. Each day of the violation shall be considered a separate violation and offense.
The provisions of this article are severable; and if any section, subsection, sentence, clause, or part thereof shall be held or declared illegal, invalid or unconstitutional by any court of competent jurisdiction, the decision shall not affect or impair any of the remaining sections. It is declared to be the intent of the Borough of Moosic that this article would have been adopted if such illegal, invalid, or unconstitutional section, subsection, sentence, clause, or part thereof had not been included.

Any ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of any such inconsistency. If this article is repealed or amended, Moosic Borough shall notify the Pennsylvania Department of Environmental Protection within 30 days of the effective date of the amendment or repeal.
This article shall become effective immediately.
