A Municipal Clerk shall be appointed by the governing body for a term consistent with, and in compliance with, the existing state law governing such appointment. Said Municipal Clerk, having held such office continually for five years from the date of the original appointment, shall have tenure in such office and shall not be removed except for good cause shown, after a fair and impartial hearing.
The governing body, by ordinance, shall fix and determine the salary to be paid to the Borough Clerk, which salary may be, from time to time, increased, decreased, or altered. No such ordinance shall reduce the salary of or deny to the Clerk during the term for which he shall have been appointed, without good cause, an increase in salary given all other municipal officers and employees.
Any Clerk appointed for so long as the population of the Borough of Chester shall be less than 2,500 may reside without the Borough of Chester.
The Borough Clerk shall:
A. 
Perform all the functions required of Municipal Clerks by the local ordinance establishing said position, as well as general election law and any other law of the State of New Jersey or ordinance of the Borough of Chester relevant to the said position.
B. 
At least seven days prior to the January organization meeting of each year, notify the members or the members-elect of the Council, as the case may be, of the place and time the Council shall meet and organize.
C. 
Post in a conspicuous place in his office a list of all public meetings to be held.
D. 
At each regular meeting of the Council, cause to be read all petitions and communications addressed to the Council, unless otherwise provided on the consent agenda.
E. 
Record the votes of all motions/resolutions and inform the Mayor of the final vote tally.
F. 
Attend and keep the minutes of the meetings of the Mayor and Council. The minutes shall be signed by the Mayor or presiding officer, and attested to by the Clerk.
G. 
Record all ordinances and resolutions in books to be provided for that purpose. For each ordinance he shall also record and certify the proof of publication thereof as required by law. Each ordinance and resolution shall be attested to by the Clerk, who shall attest it to be fully adopted upon a stated date, and when so signed the recorded copy shall be deemed public record.
H. 
Have custody of, and safely keep, all records, books, and documents of the Borough, except those committed by law or ordinance to any other office or transferred thereto by the Mayor and Council.
I. 
Cause the Corporate Seal of the Borough to be affixed to instruments and writing when authorized by ordinances or resolutions of the Mayor and Council.
J. 
Be the depository for and have custody of all official surety bonds furnished by or on account of any officer or employee, except his own bond, which shall be placed in the custody of the chief finance officer and have custody of all insurance policies of the Borough.
K. 
Be the depository for and have custody of all performance bonds running to the Borough as obligee, or any other form of security given by any person or subdivision on account of work done in or for the Borough.
L. 
Have custody of all leased property owned by the Borough.
M. 
Maintain a current file of all rules and regulations which shall be available for public inspection in his office during regular business hours. No rule or general regulation made by any department, officer, agency or authority of the Borough, except such as relates to the organization or internal management of the municipal government or a part thereof, shall take effect until filed with the Clerk.
N. 
Have the power to administer oaths and affirmations in all matters concerning Borough business.
O. 
Within five days after the Mayor and Council has appointed or elected any officer, cause to be delivered to or left at the place of abode of the person so elected or appointed, a written notice of his election or appointment.
P. 
Have such other different and additional functions, powers and duties as may be prescribed by law or ordinances, or delegated to him by the Mayor and Council.
Q. 
Sign and send all messages required to be sent from the Mayor and Council.
A. 
A Deputy Municipal Clerk may be appointed by the governing body for a term of one year or until a successor may be appointed.

B. 
The governing body shall establish a salary for the office of Deputy Clerk annually by resolution.
C. 
The Deputy Clerk shall act in the place and stead of the Municipal Clerk and shall have all the powers of the Municipal Clerk and shall perform the function and duties of such office during the absence or disability of the Municipal Clerk.
