There is hereby established in the Borough of Chester a public utility which shall be known and designated as "Chester Borough Solid Waste Utility."
Said utility shall be operated and maintained as a municipal public utility as defined in and subject to the provisions of Title 40A of the New Jersey Statutes Annotated, and said utility shall collect all fees, rates and other charges for and/or in connection with the use or services of such municipal public utility, which sums shall be kept in a fund separate from other borough revenues, to be used only for the purpose of such municipal public utility.
The Chester Borough Solid Waste Utility shall encompass all recycling and solid waste disposal services currently existing or hereinafter established by regulations of the Borough of Chester and shall include all items which the borough may from time to time purchase, acquire, construct or maintain for the purposes of the collection and disposal of recyclable materials and solid waste within the borough.

There is hereby established a separate utility in the borough to be known as the "Borough of Chester Swimming Pool Utility" (the "pool utility").
All revenue and accounting from the pool utility shall be on a dedicated utility basis in conformance with the provisions of the Local Budget Law, N.J.S.A. 40A:4-1 et seq. All moneys derived from the operation of the pool utility and any other moneys applicable to its support shall be segregated and kept in a separate fund which shall be known as the "Swimming Pool Utility Fund," and all disbursements for the operation and maintenance of the pool utility shall be taken from the pool utility fund.
The pool utility budget shall set forth the appropriations in the form and detail prescribed by regulations to be adopted by the borough and shall include categories for operations, interest and debt retirement, and deferred charges and statutory expenditures.
The borough shall establish rules and regulations and a schedule of fees in accordance with N.J.S.A. 40:61-22.26 and 40:61-22.27.
