§ 467-1 Purpose.

A. The purpose of this chapter is to establish parking prohibitions in certain areas that are on private property which is open to the public or to which the public is invited as set forth below.

B. This chapter is enacted in accordance with N.J.S.A. 40:48-2.46, which does confer upon Lower Township the right to establish certain regulations in order to preserve and safeguard the public health, safety, morals and welfare.

§ 467-2 Spaces designated.

The following areas shall be designated as off-street handicap parking spaces and shall be so marked by signs in conformance with the current Manual on Uniform Traffic Control Devices for Streets and Highways. § 467-3 Violations and penalties.

No person other than a handicapped person duly authorized by the Division of Motor Vehicles shall park a vehicle in a restricted parking space. Any person parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable to a fine of $100 for the first offense, and, for subsequent offenses, a fine of not less than $100, nor more than $1,000, and not more than 90 days' community service on such terms and in such form as the court may deem appropriate, or any combination thereof.

§ 467-4 Enforcement; additional fee.

A. Any eligible handicapped person may request that a law enforcement officer, or any law enforcement officer may on his own authority, arrange for the removal and storage of a motor vehicle which is parked unlawfully in a parking space or zone which is restricted for use by a handicapped person. It shall be the obligation of the owner of the motor vehicle to pay the reasonable costs for removal and for any storage which may result from the removal.

B. In addition to the cost of removal and storage, the owner of the motor vehicle shall pay to the Township of Lower a fee of $25.
