It is hereby declared and found that litter carelessly deposited in
the City of Gloversville is the cause of civic disgrace; that litter is a
health, fire and safety hazard and pollutant; that an all-out litter control
campaign can result in substantial savings to the taxpayers of the City of
Gloversville; and that litter is a matter affecting the public interest and
consequently should be subject to supervision and administrative control for
the purpose of safeguarding the public health, safety and general welfare
of the people of the City of Gloversville.
For the purpose of this chapter, the following terms, phrases, words
and their derivations shall have the meaning given herein. When not inconsistent
with the context, words used in the present tense include the future; words
used in the plural number include the singular number; and words used in the
singular number include the plural number. The word "shall" is always mandatory
and not merely directory.
Any store or building or group thereof, including shopping centers,
shopping plazas and other similar places, where mercantile activities and
services are offered to the public, and shall include all parking areas thereat.
Handbills, noncommercial handbills, newspapers, periodicals, garbage, refuse and rubbish, petroleum products and petroleum by-products, and materials defined in §§ 102-44; 212-3 (see definition of "junk/debris"); 212-7A; 212-13; 212-14A; 226-21; 226-22 and 226-26 of this Code, and all other waste material which, if thrown or deposited as herein prohibited, tends to create a danger to public health, safety and welfare or creates unsightliness.
The right-of-way of any road, street or highway; any park, parking
facility, playground, building or recreation area; and any residential or
commercial properties.
It shall be unlawful for any person or persons to dump, deposit, throw,
leave or cause or permit the dumping, depositing, placing, throwing or leaving
of litter on any public or private property within the city limits of the
City of Gloversville.
The Police Department, Fire Department, City Engineer, Building Inspector
and Health Officer shall administer and enforce the provisions of this chapter.

Any person violating any provision of this chapter may
be punishable by a fine of not less than $50 nor more than $250 or imprisonment
for a period not exceeding 15 days, or both.

In addition to, or in lieu of the above, and in the sound
discretion of the Gloversville City Court, any such person may be directed
by the Judge of such court to pick up and remove from any public street or
highway or public or private right-of-way or public park or, with prior permission
of the legal owner or tenant in lawful possession of such property, any private
property upon which it has been established by competent evidence or a guilty
plea that he has deposited such litter.
