A. 
The Pennsylvania Sewage Facilities Act[1] remains the applicable law regarding private sewage disposal standards.

B. 
Certain documents, three copies of which are on file in the office of the Township of Nether Providence, being marked and designated as the 1995 International Private Sewage Disposal Code and the 1996 Supplement to the International Private Sewage Disposal Code, as published by the Building Officials and Code Administrators International and the International Conference of Building Officials, is hereby adopted to supplement the Pennsylvania Sewage Facilities Act, subject to any amendments, additions or deletions that may be provided by the Township of Nether Providence, for regulating the design, construction, quality of materials, erections, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the Township of Nether Providence as therein provided. Each and all of the provisions, penalties and conditions of such International Private Sewage Disposal Code and the 1996 Supplement are hereby referred to, adopted and made a part hereof as if fully set out in this article.
C. 
As the International Private Sewage Disposal Code, 1995 and the 1996 Supplement set forth in Subsection A hereof is amended, supplemented or added to, such amendments, supplements or additions shall also be established as the law of the Township of Nether Providence. As any future amendments or editions of the International Private Sewage Disposal Code, 1995, and the 1996 Supplement described in Subsection A hereof are published, they shall also be adopted by the Township of Nether Providence.
The following sections of The 1995 International Private Sewage Disposal Code are hereby revised:
A. 
Section 101.1 Title. Insert "Township of Nether Providence" as the name of the jurisdiction.
B. 
Section 106.4.2 Fee schedule. Insert the following: "Permit fees for connecting with sewers of the Township of Nether Providence shall be in accordance with the schedule as determined from time-to-time by the Board of Commissioners."
C. 
Section 106.4.3 Fee refunds. Insert "75%" in two locations.
D. 
Section 108.4 Violation penalties. Delete Section 108.4 and substitute in lieu thereof the following: "Any person who violates any provision of this chapter or code adopted thereby shall be punishable as provided in Chapter 1, General Provisions, Art. II, Violations and Penalties, § 1-16, Building, Health and Safety Violations."
E. 
Section 108.5 Stop-Work Orders. Insert "$500" in two locations.
This article is intended to supplement all existing PA DEP regulations, as amended. Where a conflict exists between PA DEP standard(s) and this article, the PA DEP regulations shall prevail.
Nothing in this article or in the 1995 International Private Sewage Disposal Code and the 1996 Supplement hereby adopted shall be construed to affect any other suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in § 215-17 in this article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
