A certain document, one copy of which is on file in the offices of the Borough of New Wilmington, being marked and designated as the "International Plumbing Code, 1997 Edition," as published by the International Code Council, be and is hereby adopted as the Plumbing Code of the Borough of New Wilmington, County of Lawrence, Commonwealth of Pennsylvania, for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the Borough of New Wilmington and providing for the issuance of permits and collection of fees therefor, and each and all of the regulations, provisions, penalties, conditions and terms of said International Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 170-2 of this chapter.
The International Plumbing Code, 1997, is amended and revised as follows:
A. 
In Section 101.1, the words "Borough of New Wilmington" shall be inserted where applicable.
B. 
Section 106.5.2 is revised to read as follows:
106.5.2 Fee schedule. The permit fees for all plumbing work shall be set from time to time by resolution of the Borough Council.
C. 
Section 106.5.3, Fee refunds, is repealed.
D. 
Section 108.4 is revised to read as follows:
"108.4, Violations and penalties. Any person, firm or corporation who or which shall violate any provision of this code or who or which shall fail to comply with any of the requirements thereof or who or which shall install plumbing work in violation of an approved plan or directive of the Office of Code Enforcement or of a permit or certificate issued under the provisions of this code shall be punishable by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person who violates or permits the violation of this chapter shall, upon conviction in a summary proceeding, be punishable by a fine of not more than $1,000.
E. 
Section 108.5 is revised so that the last sentence refers to the penalties in Section 108.4 rather than to specific amounts.
F. 
Section 305.6.1 is revised to read as follows:
305.6.1, Sewer depth. Building sewers that connect to private sewage disposal systems, and building sewers generally, shall be a installed below finished grade the minimum number of inches determined by the appropriate borough officials.
G. 
Section 904.1 is revised to read as follows:
904.1, Roof extension. All open vent pipes that extend through a roof shall be terminated above the roof at the minimum number of inches determined by the appropriate borough officials, except that where the roof is to be used for any purpose other than weather protection, the vent extensions shall be run at least seven feet above the roof.
H. 
In Chapter 14, Referenced Standards, under the heading "Codes," insert "BOCA National Building Code, Fourteenth Edition, 1999."
