This article is enacted to maintain the peace, safety and welfare of the Borough and its residents.
Words and phrases shall have the same meanings as the Pennsylvania Liquor Code.[1]

No person shall serve, sell, dispense, drink or consume any alcoholic beverage in any quantity upon any public street, highway, avenue, alley, thoroughfare or road within the Borough or upon any public grounds, parks, sidewalks or the public properties of the Borough or in any automobile or other vehicle or any other means of transportation while on the public streets, highways, alleys, avenues, public grounds, parks or sidewalks within the Borough.
No person shall possess any container of alcoholic beverage, whether wrapped or unwrapped, which has been opened or on which the seal has been broken in any manner upon any public street, highway, avenue, alley, thoroughfare or road within the Borough or upon any public grounds, parks or sidewalks or the public properties of the Borough or in any automobile or other vehicle or any other means of transportation while on the public streets, highways, alleys, avenues, public grounds, parks or sidewalks within the Borough.
A. 
This article shall not apply to the exterior grounds of any private property, nor to the consumption or possession by persons of any duly prescribed and dispensed medication having alcoholic content. Also, it shall not apply to premises duly licensed by the Pennsylvania Liquor Control Board, or its successor, and to persons then and there patrons with said licensee.
B. 
This article shall not apply to any person engaged or participating in any event or activity for which a permit has been issued by the Borough or any duly authorized state agency. Such exclusion shall be limited to the time and place and subject to the conditions stated within said permit.
Any police officer of the Borough is authorized to arrest, on view and without warrant, any person violating this article. In lieu thereof, any person violating this article shall be served with a citation or summons.
Any person who violates any provision of this article shall, upon conviction, be sentenced to pay a fine of not less than $25 nor more than $500 and costs of prosecution and, upon refusal to pay said fine and costs, to undergo imprisonment not exceeding 30 days or to perform community service not exceeding 30 days.
