The Borough of Ridley Park hereby adopts, for the purpose of
prescribing regulations governing the safe installation and maintenance
of all mechanical equipment, the mechanical code known as the "International
Mechanical Code, 1998 Edition," of which one copy has been and now
is filed in the office of the Borough Manager, and the same is hereby
adopted and incorporated as fully as if set out at length herein.
The International Mechanical Code, 1996 Edition, hereby adopted,
is amended as follows:
A.
Section 101.1 is hereby amended to read as follows:

Title: These regulations shall be known as the
"Mechanical Code of the Borough of Ridley Park," hereinafter referred
to as "this code."

B.
Section 103.1 is hereby amended to read as follows:

Code official: It shall be the duty and responsibility
of the Code Enforcement Officer or such other person designated by
Borough Council to enforce the provisions of this code.

C.
Section 103.2 is hereby amended to read as follows:

Appointment: The Code Official shall be appointed
by the Borough Council of the Borough of Ridley Park to serve for
such term as it shall determine.

D.
Section 106.5.2 is hereby amended to read as follows:

Fee Schedule: The fees for all mechanical work
shall be in accordance with a fee schedule adopted by resolution by
Borough Council for the Borough of Ridley Park as said fee schedule
may be amended from time to time. Any request for fee refunds shall
be determined by motion of Borough Council.

Section 108.4 is hereby amended to read as follows:

Penalties: Any person who shall violate a provision
of this code or shall fail to comply with any of the requirements
thereof or who shall erect, install, alter or repair mechanical work
in violation of the approved construction documents or directive of
the Code Official, or of a permit or certificate issued under the
provision of this code, shall be guilty of a summary offense and,
upon conviction thereof, shall be sentenced to pay a fine of not more
than $1,000 and in default of payment thereof shall be imprisoned
for a period not exceeding 30 days. Each day that a violation continues
shall be deemed a separate offense. This section shall also govern
Section 108.5 relating to stop-work orders.

Sections 109.2.1 through 109.6.2 are hereby amended by deleting said
sections and inserting the following in place thereof:

Appeals: Appeals to the Board of Appeals may be
taken by any person aggrieved by a decision or interpretation of the
Code Official made under the provision of this code. The Board of
Appeals may adopt reasonable rules and regulations for conducting
its hearings. All Board hearings shall be open to the public. The
decision of the Board shall be by resolution. Certified copies shall
be furnished to the appellant and to the Code Official.

The provisions of this chapter shall not affect any act done
or liability incurred, nor shall they affect any suit or prosecution
pending or to be instituted to enforce any right or penalty or to
punish any offense under authority of any of the repealed ordinances.
