A.
No person owning or occupying any property within
the Township shall permit any grass or weeds or any vegetation whatsoever,
not edible or planted for some useful or ornamental purpose, to grow
or remain upon those premises so as to exceed a height of six inches
or to throw off any unpleasant or noxious odor or to conceal any filthy
deposit or to create or produce pollen or any hazardous condition.
B.
Any grass, weeds or other vegetation growing upon
any premises in the Township in violation of any provision of this
section is declared to be a nuisance and detrimental to the health,
safety, cleanliness and comfort of the inhabitants of the Township.
C.
In the case of any tract of undeveloped land five
acres or more in area, this section shall not apply to grass, weeds
of other vegetation growing more than 150 feet from any public street
in the Township or more than 150 feet from any residence.
D.
Provided further, this section shall not apply to
any farm land or forested land.

The owner of any premises and, in the case of any premises occupied by other than the owner, the occupant of the premises shall be responsible to remove, trim or cut all grass, weeds or other vegetation growing or remaining on those premises in violation of any provision of § 76-1.

The Board of Commissioners, or any officer or employee of the Township designated by the Board of Commissioners for the purpose, is hereby authorized to give notice, by personal service or by United States Mail, to the owner or occupant, as the case may be, of any premises whereon grass, weeds or other vegetation is growing or remaining in violation of any provision of § 76-1, directing and requiring that owner or occupant, or both, to remove, trim or cut the grass, weeds or vegetation, as to conform to the requirements of this chapter, within five days after issuance of the notice. In case any person neglects, fails or refuses to comply with the notice within the period of time stated on it, the Township authorities may remove, trim or cut the grass, weeds or vegetation, and the cost thereof, together with any additional penalty authorized by the law, may be collected by the Township from that person in the manner provided by law.
Every person who violates or who fails, neglects or refuses to comply with any provision of this chapter shall be guilty of a violation and for every such violation, upon conviction, shall be sentenced to pay a fine of not less than $50 or more than $600 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days. Each day's continuance of a violation, after the expiration of the time limit specified in the notice referred to in § 76-3, shall constitute a separate violation.
