This chapter shall be cited as the "Rostraver Township Minibike Control Ordinance of 1974."
The Board of Commissioners of Rostraver Township has determined that the prevalent use of minibikes, snowmobiles, two-wheeled and three-wheeled vehicles or skid-equipped vehicles which are unlicensed and self-powered have become a very serious detriment to the health, comfort, living conditions, welfare and safety of the citizens of Rostraver Township. It is hereby declared to be the policy of the Board of Commissioners to safeguard the citizens of Rostraver Township from such danger and nuisance.
The following words, terms and phrases, when used in this chapter, unless the context clearly indicates otherwise, shall have the following meanings ascribed to them:
BOARD
The Township Board of Commissioners.
PERSON
An individual, regardless of age.
VEHICLE
Self-powered, unlicensed, two-wheeled or three-wheeled vehicle or skid-equipped vehicle.
The Rostraver Township Police Department shall have the power and duty to enforce the provisions of this chapter.
After the enactment of this chapter, no person or individual, regardless of age, shall operate a self-powered, two-wheeled or three-wheeled vehicle or skid-equipped vehicle that is unlicensed upon the streets and alleys or public property of the Township.
Any person who violates any provision of this chapter shall first be given a warning, and if that person is under the age of 16 years, that warning shall be given to the parent or guardian of that minor, the warning shall be in writing and recorded by the Police Department. Upon the second violation of any provision by the same person, that person, upon conviction, shall be sentenced to pay a fine of not less than $50 or more than $600 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days. Each violation of any provision of this chapter, and each day on which the violation continues shall be deemed a separate offense.
