A. 
The applicant must notify the Township in advance before the commencement of construction.
B. 
Regular inspections of the stormwater management system construction shall be conducted by the staff of Rostraver Township or certified by a professional engineer or his/her designee who has been approved by Rostraver Township. All inspections shall be documented and written reports prepared that contain the following information:
(1) 
The date and location of the inspection.
(2) 
Whether construction is in compliance with the approved stormwater management plan.
(3) 
Variations from the approved construction specifications.
(4) 
Any violation that exist.
C. 
If any violations are found, the property owner shall be notified, in writing, of the nature of the violation and the required corrective actions. No added work shall proceed until any violations are corrected and all work previously completed has received approval by the Township of Rostraver.
A. 
Upon presentation of proper credentials, duly authorized representatives of the municipality may enter at reasonable times upon any property within the municipality to inspect the implementation, condition, or operation and maintenance of the stormwater BMPs in regard to any aspect governed by this chapter.
B. 
BMP owners and operators shall allow persons working on behalf of the municipality ready access to all parts of the premises for the purposes of determining compliance with this chapter.
C. 
Persons working on behalf of the municipality shall have the right to temporarily locate on any BMP in the municipality such devices as are necessary to conduct monitoring and/or sampling of the facility’s stormwater discharge.
D. 
Unreasonable delay in allowing the Director access to a BMP is a violation of this article.
All applicants are required to submit actual as-built plans for any stormwater management practices located on site after final construction is completed. The plan must show the final design specifications for all stormwater management facilities and must be certified by a professional engineer. A final inspection by Rostraver Township is required before the release of any performance securities can occur.
A. 
Any area of land from which the natural vegetative cover has been either partially or wholly cleared or removed by development activities shall be revegetated within 10 days from the substantial completion of such clearing and construction. The following criteria shall apply to revegetation efforts:

Reseeding must be done with an annual or perennial cover crop accompanied by placement of straw mulch or its equivalent of sufficient coverage to control erosion until such time as the cover crop is established over 70% of the seeded area.
C. 
Replanting with native woody and herbaceous vegetation must be accompanied by placement of straw mulch or its equivalent of sufficient overage to control erosion until the plantings are established and are capable of controlling erosion.
Inspection programs may be established on any reasonable basis, including but not limited to routine inspections; random inspections; inspections based upon complaints or other notice of possible violations; inspection of drainage basins or areas identified as higher than typical sources of sediment or other contaminants or pollutants; inspections of businesses or industries of a type associated with higher than usual discharges of contaminants or pollutants or with discharges of a type which are more likely than the typical discharge to cause violations of state or federal water or sediment quality standards or the NPDES stormwater permit; and joint inspections with other agencies inspecting under environmental or safety laws. Inspections may include, but are not limited to: reviewing maintenance and repair records; sampling discharges, surface water, groundwater, and material or water in drainage control facilities; and evaluating the condition of drainage control facilities and other stormwater treatment practices. The minimum inspection shall be as follows:
A. 
The Township Engineer or his designee shall inspect all phases of development of the site including but not limited to:
(1) 
Completion of preliminary site preparation including stripping of vegetation, stockpiling of topsoil, and construction of temporary stormwater management and erosion control facilities.
(2) 
Completion of rough grading, but prior to placing topsoil, permanent drainage or other site development improvements and ground covers.
(3) 
During construction of the permanent stormwater facilities at such times as specified by the Municipal Engineer.
(4) 
Upon completion of permanent stormwater management facilities, including established ground covers and plantings.
(5) 
Upon completion of any final grading, vegetative control measures or other site restoration work done in accordance with the approved plan and permit.
B. 
No work shall begin on a subsequent stage until the preceding stage has been inspected and approved by the Township Engineer.
C. 
It is the responsibility of the permittee to notify the Municipal Engineer 48 hours in advance of the completion of each identified phase of development.
D. 
Any portion of the work which does not comply with the approved plan must be corrected by the permittee within 72 hours. No work may proceed on any subsequent phase of the stormwater management plan, the subdivision or land development or building construction until the required corrections have been made.
E. 
If at any stage of the work, the Municipal Engineer determines that the soil or other conditions are not as stated or shown in the approved application, he may refuse to approve further work and the municipality may revoke existing permits until a revised plan is submitted and approved.
Parties responsible for the operation and maintenance of a stormwater management facility shall make records of the installation and of all maintenance and repairs, and shall retain the records of the installation and of all maintenance and repairs, and shall retain the records for at least five years. These records shall be made available to the Township of Rostraver during inspection of the facility and at other reasonable times upon request.
If a responsible party fails or refuses to meet the requirements of the maintenance covenant, the Township of Rostraver, after reasonable notice, may correct a violation of the design standards or maintenance needs by performing all necessary work to place the facility in proper working condition. In the event that the stormwater management facility becomes a danger to public safety or public health, the Township of Rostraver shall notify the party responsible for maintenance of the stormwater management facility in writing. Upon receipt of that notice, the responsible person shall begin remedial action immediately and shall complete within five days, the maintenance and repair of facility in an approved manner. After proper notice, Rostraver Township may assess the owner(s) of the facility for the cost of repair work and any penalties; and the cost of the work shall be a lien on the property, or prorated against the beneficial users of the property, and may be placed on the tax bill and collected as ordinary taxes by the county.
