This chapter shall be known and cited as the "South Fayette Township Disorderly Location Ordinance."
By enacting this chapter, the Board of Commissioners recognizes the need to regulate the habitual disorderly conduct which frequently occurs at certain locations within the Township. The recitals to this chapter are incorporated by reference herein and made a part hereof.
This chapter and the objectives leading to its enactment are authorized by the provisions of the First Class Township Code, and specifically by law codified at 3 P.S. § 56502 et seq.
For the purpose of this chapter, a "disorderly location" is defined as a dwelling or nonresidential structure being maintained for the encouragement of idleness, gaming, drinking, fighting or other misbehavior, or a location which acts as a common nuisance or disturbance to the neighborhood or to the Township's orderly citizens. A location will be deemed to be a disorderly location under this chapter if the police have been called, or have responded to calls regarding the same location on at least three separate occasions in any three-consecutive-month period for the purpose of controlling a fight, responding to complaints from individuals relating to noise and/or violence, and/or for the purpose of controlling other misbehavior. A location shall be deemed to be a disorderly location even if the acts described herein were performed or perpetrated by the property's owner, tenant, and/or their invitees.
It shall be unlawful for any person to own, operate, lease or otherwise supervise any ill-governed or disorderly location or place in South Fayette Township.
Any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 and the costs of prosecution, and in default of payment of said fines and costs, to imprisonment for a term not to exceed 30 days. Each day that a violation of this chapter continues shall constitute a separate offense.
