It is hereby declared necessary, for the protection, benefit and safety
of the general traveling public, and inhabitants of Straban Township, to require
permits for the construction or reconstruction or connection of ways or means
of ingress and egress to ordained township road rights-of-way and for the
sinking of bar holes in bituminous surfaced roads.
For the purposes of this chapter, the following words and phrases shall
have the meaning ascribed to them as set forth in this chapter:
A hole made by any means in bituminous surfaced roads, not exceeding
four inches in diameter.
The Board of Supervisors, Straban Township.
Any individual, firm, partnership, company, corporation, trustee,
association or private entity.
Straban Township, Adams County, Pennsylvania.

No person shall construct or reconstruct any drive or
other means of ingress or egress or connection made with any ordained township
road right-of-way, nor shall any bar hole or holes be made in bituminous surfaced
roads, except under such conditions and specifications as prescribed by the
Board and contained in permits granted by the township for such purpose.

The application for a permit shall be made on a form
prescribed by the township and be submitted to the Township Secretary, in
triplicate, accompanied by an equal number of copies of a sketch or drawing
setting forth the applicable information, including widths, depths and right-of-way
lines. Multiple drives and bar holes are to be considered as the part of one
project and subject to a single application and permit, provided that the
work is executed at one time.

When the procedures hereinabove have been followed and
met, the Board shall then authorize its Secretary to issue a permit for said
occupancy, subject to the general provisions and specifications regulating
occupancy of township highways, as currently adopted by the Pennsylvania Department
of Transportation.

Upon completion of the work, the permittee shall give
written notice to the township.

Inspection of the completed work shall be made by the
Board or its authorized representative. When conditions are found not in accordance
with the permit, then the township shall, by certified mail or personal delivery,
notify the permittee of the noncompliance and request remedy within 30 days.
If the permittee fails to rectify the defect within 30 days, then in such
case the township may do the work and shall impose upon the permittee the
cost thereof, together with an additional 20% of such cost.[2]
Any person violating this chapter shall, upon a summary conviction before
a District Justice, be sentenced to pay a fine of not more than $1,000 and
costs of prosecution, or shall undergo imprisonment for not more than 30 days,
or both.
