[HISTORY: Adopted by the Township Council of the Township of Washington
9-29-1995 by Ord. No. 9-95. Amendments noted where applicable.]
It is hereby resolved and enacted by the Council of Washington Township,
Erie County, Pennsylvania, that, to the extent set forth below, said proposal
and modifications thereto are hereby adopted.[1]

in the preamble to Ord. No. 9-95, which provided as follows:
"WHEREAS, pursuant to Act 43 of 1981 (Public Law 128), as amended,
known as the "Agricultural Area Security Law," certain owners of real property
situated in Washington Township, Erie County, Pennsylvania, have proposed
the creation of an agricultural security area within Washington Township;
and
WHEREAS, the Washington Township Council accepted said proposal on
April 4, 1995, and formed an Agricultural Security Area Advisory Committee;
and
WHEREAS, the Washington Township Council duly notified the public
of said proposal, and referred the said proposal to the Washington Township
Planning Commission and to the Agricultural Security Area Advisory Committee
for review; and
WHEREAS, the Agricultural Security Area Advisory Committee presented
certain recommendations to the Washington Township Council with respect to
the proposed agricultural security area; and
WHEREAS, the Washington Township Council accepted certain modifications
to the said proposal whereby certain owners of the property situated in Washington
Township requested that their properties be included in the agricultural security
area; and
WHEREAS, pursuant to the Agricultural Area Security Law, on September
28, 1995, the Washington Township Council conducted a duly advertised public
hearing on September 27, 1995, relative to the proposed agricultural security
area, the modifications thereto, and the recommendations thereto from the
Agricultural Security Area Advisory Committee; and
WHEREAS, all procedures and requirements of the Agricultural Security
Law have been met and satisfied; and
WHEREAS, the Agricultural Area Security Law grants to the Washington
Township Council the authority to adopt or reject the said proposal or any
modification thereto that they deem appropriate;"
Said agricultural security area shall include an aggregate total of
3,412.159 acres, comprised only of the designated properties listed and described
on the attached document entitled "Description of Washington Township Agricultural
Security Area," which by this reference is incorporated herein and made a
part of this chapter as if fully set forth.[1]
