A.
The survey of existing or proposed public streets, watercourses
and public grounds attached hereto shall be the Official Map of Whitemarsh
Township.
B.
All recorded plats which shall have been approved or
which shall be approved as provided by statute shall be deemed amendments
to the Official Map without a further public hearing or notice given.
C.
The Official Map shall otherwise be modified or amended
only by amendatory ordinances enacted by the Board of Supervisors of Whitemarsh
Township pursuant to public notice and public hearing thereon.
D.
The adoption of any street or street line as part of
this Map shall not, in and of itself, constitute or be deemed to constitute
the opening or establishment of any street nor the taking or acceptance of
any land for street purposes, nor shall it obligate Whitemarsh Township to
improve or maintain any such street.
E.
The adoption of proposed watercourses or public grounds
as part of the Official Map shall not, in and of itself, constitute or be
deemed to constitute a taking or acceptance of any land by Whitemarsh Township.
F.
No permit shall be issued for any building within the
lines of any street, watercourse or public ground shown or laid out on the
Official Map.
G.
No person shall recover any damages for the taking for
public use of any building or improvements constructed within the lines of
any street, watercourse or public ground after same shall have
been included in the Official Map, and any such building or improvement shall
be removed at the expense of the owner, unless the owner has secured a permit
as provided in § 405 of the Act of July 31, 1968, P.L. 247 (53 P.S.
§ 10405).
