There is hereby created and established in and for the Town of New Castle a Board to be known as the "New Castle Environmental Review Board," which shall assume all duties of the existing New Castle Conservation Board, pursuant to the provisions of the New Castle Wetlands Law, Chapter 137 of the Town Code. The New Castle Conservation Board shall continue to perform such other duties as the Town Board has assigned to it and may assign to it from time to time.
A. 
The Board shall consist of five members, who shall be residents of the Town of New Castle. They shall serve without compensation and shall be appointed by the Town Board of the Town of New Castle to serve for terms of three years or until successors are appointed, with no more than two terms expiring in any one year. Of the Environmental Review Board members first appointed, two shall hold office for terms of one year, two for terms of two years and one for the term of three years.
B. 
Vacancies in such Board shall be filled by appointment of the Town Board and, where occurring otherwise than by expiration of term, shall be for the unexpired term of office.
C. 
The Chairman shall be the executive officer of the Board. He shall preside at meetings of the Board.
A. 
The Town Board shall designate one of the members of said Board as its Chairman, who shall serve for a term of one year from his appointment or until his successor is chosen. Meetings of the Environmental Review Board shall be held at such times as the Environmental Review Board may determine. Three members of the Environmental Review Board shall constitute a quorum for making a decision on an application.
B. 
The Chairman shall take and keep in a proper book true and correct minutes of all meetings and shall notify members of the time and place of all meetings.
The Town Board may authorize and budget for such expenses of the Environmental Review Board as may be necessary and proper.
This chapter shall become effective upon filing with the Secretary of State.
