It shall be unlawful for any person, firm or corporation:
A. 
To deposit or cause to be deposited any refuse, garbage, debris or other waste material upon any street, alley, public land or land owned by another or in any culvert, stream or body of water in the Town of New Castle.
B. 
To maintain within said Town any dump for the deposit of refuse, garbage, debris or other waste material or to dump the same or cause or permit the same to be dumped or accumulated within said Town without first obtaining a permit therefor.

The Town Engineer of the Town of New Castle is hereby empowered:
A. 
To issue permits, which shall be renewable annually, for the operation and maintenance of dumps within those areas in the Town of New Castle as shall from time to time be designated by resolution of the Town Board of said Town.
B. 
To revoke any such permit forthwith or upon such notice as he or she shall determine in the event that any dump maintained or operated in pursuance thereof shall constitute a menace to the health, safety or general welfare of the residents of the Town of New Castle.
The deposit of refuse and waste material in a closed container or containers or the arrangement of refuse and waste material not suitable for deposit in containers in neat stacks or piles secured against the wind, so placed as to be picked up by a regularly scheduled garbage or refuse disposal collector, shall not constitute a violation of this chapter.
This chapter shall be effective within the area comprising the Town of New Castle, exclusive of land situated wholly within the limits of the Incorporated Village of Mount Kisco.

Any person committing an offense against any provision of this chapter shall be guilty of a violation punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
