A. 
No person shall destroy any tree located in the Village and owned by or under the control of the Village without first obtaining a permit therefor from the Village.
B. 
No person shall injure, damage, prune, trim or remove any tree located in the Village and owned by or under the control of the Village without written authorization from the Village.

C. 
No person shall affix or attach a sign to any tree located in the Village and owned by or under the control of the Village.
D. 
Nothing herein contained shall be construed to prohibit the affixing or attaching of numerical characters comprising the house number of a single-family residence, to any tree located on the property of such residence and owned by or under the control of the Village, in a manner that will not injure, damage or destroy such tree, no digit of which house number may exceed four inches by four inches in size.
A. 
No person shall injure or deface any building, fence, lighting standard or other property, real or personal, belonging to and/or under the control of the Village and/or the Russell Gardens Association, Inc., or its successor.
B. 
The Village may assess the costs of repairing a sidewalk or other property of the Village against the property of the private property owner who causes damage to an abutting sidewalk or other property where such sidewalk or other property lies upon land in which the property owner has an interest.

A. 
Violations; fines.
(1) 
An offense against any provision of this chapter shall constitute a violation. Any person who shall be guilty of a violation of §§ 52-1A or B shall be subject to a fine not to exceed the amounts as set forth below for each violation:
(a) 
Trees six inches up to 11 inches in diameter: $5,000.
(b) 
Trees 11 inches to 17 inches in diameter: $10,000.
(c) 
Trees in excess of 17 inches in diameter: $10,000 plus $5,000 for each additional six inches in diameter, or part thereof.
(2) 
Each tree cut down, removed or destroyed, and each tree the habitat of which is substantially altered in violation of the provisions of this chapter, shall constitute a separate violation.
(3) 
In the event that two or more trees are removed, destroyed or altered without a permit, the maximum fines set forth above may be doubled for each tree, even if such removal of trees did not take place on the same day.
B. 
In addition to the above, any trees removed, destroyed or substantially altered in violation of this chapter shall be replaced, at the cost and expense of the person who removed, destroyed or altered the trees, with new trees of a diameter and species approved by the Building Inspector. Such person shall also, at its cost and expense, remove the stumps of any trees that have been removed, destroyed or altered in violation of this chapter.
