The Estell Manor Volunteer Fire Company, heretofore organized pursuant to N.J.R.S. 15:8-1 et seq., is hereby authorized and established as the official Fire Department for the City of Estell Manor, along with such additional Companies of said Fire Department as the City Council may hereafter authorize and approve.

No person shall hereafter become a member of the Estell Manor Volunteer Fire Company or any unit thereof unless he or she has attained the age of at least 18 years, except that an individual may serve as an Explorer Member at the minimum age of 14 years.

Explorer Member activities and supervision are to be governed by the bylaws of the Fire Company relating to Explorer Members, which section of those bylaws is adopted by the City Council as the rules and regulations governing such membership, and which section of those bylaws may not be amended without the consent, by ordinance, of the City Council.
Every member of the Estell Manor Volunteer Fire Company shall, in each and every year, attend and perform at no less than 60% of duty, composed of actual attendance and duty at fires and drills. A record shall be kept of such attendance and duty by the Chief of the Fire Company and reported to the City Council annually.

Every person seeking to join the Fire Company shall make application to the officers thereof, and upon his or her election to membership by vote of the majority of the unit present and voting, he or she shall become a member in good standing of the Fire Company, and the new members's name shall be forwarded to the City Clerk for recording.
Exemption certificates may be issued to members of the Fire Company who shall have served seven years in active duty under municipal control as provided herein, and who shall have otherwise generally complied with all the requirements of N.J.R.S. 40A:14-55 et seq.
All ordinances or parts of ordinances in conflict with this chapter are hereby repealed. It is the intention of this chapter to comply generally with the provisions of N.J.R.S. 15:8-1 et seq., as it applies to the lawful constitution of the Estell Manor Volunteer Fire Company and with the definitions, requirements and qualifications set forth in N.J.R.S. 40A:14-55 et seq. In the event of a conflict between the provisions of this chapter and the statutes aforesaid, the provisions and interpretations of such statutes shall control.

A Length of Service Awards Program (LOSAP) is herewith created in accordance with Chapter 338 of the Laws of 1997, to reward members of the volunteer firefighters for their loyal, diligent and devoted services to the residents of the City of Estell Manor.
The LOSAP shall provide for fixed annual contributions to a deferred income account for each volunteer member that meets the criteria set forth below; that such contributions shall be made in accordance with a plan that shall be established by the City of Estell Manor pursuant to P.L. 1997, c. 338; and that such plan shall be administered in accordance with the laws of the State of New Jersey, the United States Internal Revenue Code and this section.
The LOSAP shall provide for annual contributions to each eligible member that meets the criteria as follows:
Two hundred twenty-five points are required for a member to be eligible for an annual contribution (see Schedule A[1]).

Five years of service are required for vesting.
The annual contribution shall be $550 per eligible member.
The LOSAP shall provide previous credit for vesting purposes only for no more than five years of prior service for each eligible volunteer considered each year as an "active and in good standing member" for each individual year.
The estimated cost of the program has been calculated as follows:
For regular annual services: $14,850 per year.
For contributions for prior years service: $11,000 per year for an estimated five years.
Each active volunteer shall be credited with points for volunteer services provided to the volunteer fire company in accordance with the following schedule (see Schedule A[2]).

This section shall not take effect unless it is approved by voters as a public question at the next general election.[3]
