The offices of the Derry Township Auxiliary Police and Hershey Fire Police are hereby abolished.
The office of Derry Township Special Fire Police, whose members shall consist of members of the Hershey Volunteer Fire Company nominated to serve as special fire police, which nominations shall be approved by the Derry Township Chief of Police, is hereby created.
All nominees to the office of special fire police before entering upon their duties shall be confirmed and sworn by the Chairman of the Derry Township Board of Supervisors.
When so confirmed and sworn and displaying a badge of authority in the course of performing their duties by, at a minimum, the wearing of a distinctive armband or hat or uniform or insignia, the special fire police shall have full power to:
A. 
Regulate traffic and keep crowds under control at or in the vicinity of any fire at which the Hershey Volunteer Fire Company is in attendance and exercise such other police powers as are necessary in order to facilitate and prevent interference with the work of firemen in extinguishing fires.
B. 
Perform their duties when functioning as special fire police at any function, event or parade conducted by, and under the auspices of, any volunteer fire company, or any other event, function or parade conducted by an organization other than the Hershey Volunteer Fire Company; provided, that the request to perform these duties is made by the Derry Township Board of Supervisors when the event will be conducted in Derry Township. Such events other than those conducted by the Hershey Volunteer Fire Company shall include, but not be limited to, the antique auto show and the various Hershey Park events.
C. 
Perform their duties of traffic and crowd control, as required when accidents, floods or any other emergencies occur. Such duties may be performed without the prior request of the Derry Township Board of Supervisors until the arrival of either the Pennsylvania State Police or the Derry Township Police and thereafter subject to the direction of either police authority until the emergency no longer exists.
A person functioning as special fire police and performing a duty under any of the conditions stated in § 19-4 hereof shall be deemed to be performing the duties of his employment.
Under no circumstances shall special fire police have the right or power to use firearms or other weapons in the performance of their duties as special fire police.
