The Board of Trustees of the Village of Great Neck Plaza hereby finds
that a substantial number of its residents live in multiple dwellings. For
this reason, the condition of these multiple dwellings and information regarding
them and tenants residing therein directly relate to the property, affairs
and government of the village. The Board of Trustees believes that matters
related to multiple dwellings and the tenants therein should be dealt with
on a coordinated basis. The Board of Trustees therefore finds that it is necessary
to adopt this chapter in order to establish a Department of Housing, whose
primary responsibility will be to coordinate all services and programs related
to multiple dwellings.
The definitions contained in Chapter 124, Housing Maintenance Standards, shall apply to this chapter.
A.
There shall be a Department of Housing which shall consist
of a Division of Housing Inspection and Code Enforcement, a Division of Information
and Counseling, a Division of Research and such other divisions as may be
established from time to time by the Board of Trustees.
B.
The Department of Housing shall have jurisdiction over
all residential premises. This shall include:
(1)
Lots, plots or parcels of land on which residential buildings,
buildings of mixed occupancy or accessory structures are located;
(2)
Residential buildings, including one- and two-family
dwellings and multiple dwellings;
(3)
Residential occupancies in buildings of mixed occupancy;
and
(4)
Accessory structures, accessory to residential occupancies.
A.
The head of the Department of Housing shall be a Commissioner
of Housing, who shall be a village officer and shall have responsibility for
supervising the activities of the Department of Housing.
B.
The Commissioner of Housing shall be appointed by the
Board of Trustees. The Commissioner of Housing shall hold office for one official
year, or the portion remaining thereof after appointment, in accordance with
the applicable provisions of the Village Law. The compensation of the Commissioner
of Housing shall be fixed by resolution of the Board of Trustees.
C.
The Commissioner of Housing shall have the power to adopt
such rules and regulations as are necessary in connection with interpreting
and implementing the provisions of this chapter and all local laws and ordinances
for which it has the responsibility of enforcement.
A.
There shall be a Housing Inspector, who shall be the
head of the Division of Housing Inspection and Code Enforcement. The Housing
Inspector shall be a village officer who shall be appointed by the Board of
Trustees for one official year, or the portion remaining thereof after appointment,
in accordance with the applicable provisions of the Village Law. The compensation
of the Housing Inspector shall be fixed by resolution of the Board of Trustees.
B.
The Division of Housing Inspection and Code Enforcement
shall administer and enforce the provisions of the Housing Code of the Village
of Great Neck Plaza and such other local laws and ordinances as required by
the Board of Trustees.
A.
There shall be a division of information and counseling.
The head of said division shall be the Commissioner of Housing or such other
person as is designated by the Board of Trustees.
B.
The Division of Information and Counseling shall provide
advice to residents of the village and persons doing business in the village
regarding the provisions of any law, chapter or ordinance which relates to
the operation or condition of any multiple dwelling in the village. The Division
of Information and Counseling shall also have the power to assist any such
person in obtaining enforcement of any such law, local law or ordinance, but
said power shall not include the representation of such person in any administrative
or legal proceeding.
A.
There shall be a Division of Research. The head of such
division shall be the Commissioner of Housing or such other person as is designated
by the Board of Trustees.
B.
The Division of Research shall have the following responsibilities:
(1)
To make recommendations to the Mayor and the Board of
Trustees for additional village, county, state and federal legislation which
is needed in connection with the operation of multiple dwellings.
(2)
To make recommendations to the Mayor and the Board of
Trustees for the establishment of additional village services or programs
to meet the needs of owners and tenants of multiple dwellings.
(3)
To determine what public and private resources are available
to implement the programs of the village as they relate to the operation of
multiple dwellings and the needs of the tenants residing therein.
A.
There shall be an advisory council whose purpose shall
be to consider problems of mutual interest to owners and tenants of multiple
dwellings and to thereby achieve and maintain a harmonious relationship between
these groups.
B.
The Chairman of the advisory council shall be the Commissioner
of Housing. The Commissioner of Housing shall appoint the members of the council,
which shall consist of five apartment house owners to be recommended by the
owners of multiple dwellings in the village and five tenants to be selected
by the Commissioner of Housing. The advisory council shall meet monthly and
at such other times as the Commissioner of Housing may designate. The advisory
council shall also meet at the request of any three members of the advisory
council.
Any person who refuses to provide any information which is required
to be provided under this chapter or any rule or regulation adopted by the
Commissioner of Housing pursuant to this chapter and any person who falsifies
any such information shall pay a penalty not to exceed $250 or imprisonment
for a period not to exceed 15 days, or both, for each violation.
