It is the policy of the Village of Great Neck Plaza ("the village")
to provide for the reasonable development of land within the village in an
orderly, efficient and economic manner. The Board of Trustees of the village
hereby determines that a Planning Board will further that policy.
A.
The Village Planning Board is hereby established in accordance
with the provisions of Article 7 of the New York State Village Law, except
as superseded by the provisions of this chapter.
B.
The Planning Board shall consist of five members. These
members shall be the same persons who are members of the Village Board of
Trustees. Their terms as members of the Village Planning Board shall coincide
with their terms as members of the Board of Trustees.
C.
The Mayor shall be the Chairperson of the Village Planning
Board.
D.
Members of the Planning Board shall receive no compensation
in addition to their compensation as members of the Board of Trustees.
E.
Sections 7-718, Subdivisions 1, 3, 4, 5 and 8, of the
Village Law of the State of New York are hereby repealed in their application
to the Village of Great Neck Plaza, effective July 1, 1993.
A.
All meetings of the Planning Board shall be held at the
call of the Chairperson and at such other times as the Planning Board may
determine. Such Chairperson, or, in his or her absence, the Acting Chairperson,
may administer oaths and compel the attendance of witnesses.
B.
The Planning of the Village Board shall review all applications under Chapter 187, Subdivision of Land, relating to subdivisions of land and change of property lines within the village.
C.
The Planning Board shall have jurisdiction over all matters
referred to it by the Board of Trustees or required to be referred to it under
state or local law.
D.
The Planning Board may, after public hearing, recommend
to the Village Board of Trustees regulations relating to any subject matter
over which the Planning Board has jurisdiction under state or local law. Adoption
of any such recommendations by the Village Board of Trustees shall be by local
law.
E.
The Village Board of Trustees may, by resolution, provide
for the reference of any matter or class of matters to the Planning Board
before final action is taken thereon by the Board of Trustees or other office
or officer of said village having final authority over said matter. The Board
of Trustees may further stipulate that final action thereon shall not be taken
until the Planning Board has submitted its report thereon or has had a reasonable
time, to be fixed by the Village Board of Trustees in said resolution, to
submit the report.
F.
The Planning Board shall have the full power and authority
to make such investigations, maps, reports and recommendations in connection
therewith relating to the planning and development of the village as it seems
desirable, provided that the total expenditures of said Board shall not exceed
the appropriation provided therefor.
G.
The fee and costs for any application to the Planning Board shall be the same as those specified in Chapter 187, Subdivision of Land, for an application to the Planning Board relating to a subdivision or change in property line.
H.
Subject to the approval of the Board of Trustees, the
Planning Board shall have the authority to hire such employees as it deems
necessary. for the satisfactory performance of its functions including, among
others, a clerk and a secretary.
