The Board of Trustees hereby finds that it is
necessary to regulate the use of its municipal garages and parking
fields in order to promote the safety and general welfare of the public.
The following terms, when used in this article,
shall have the following meanings:
The individual who is applying for a parking permit.
The Board of Trustees of the Village of Great Neck Plaza.
A group of two or more persons who travel together in one
vehicle to work in the Village of Great Neck Plaza.
Includes any vehicle with a commercial license plate; any
vehicle defined as a commercial motor vehicle by the New York State
Vehicle and Traffic Law; trucks, buses, taxis and vans; and any vehicle
used primarily for the delivery of goods in connection with a commercial
enterprise.
Any person who works for an employer within the Village of
Great Neck Plaza.
Any person who owns or operates a business within the Village
of Great Neck Plaza.
The municipal garages at Plaza Centre and Maple Drive.
Every device in, upon or by which any person whose property
is or may be transported or drawn upon a highway.
The Clerk of the Village of Great Neck Plaza.

A.
Except for metered spaces and except as otherwise authorized by the
Board of Trustees, no person shall park a motor vehicle in either
of the municipal garages between the hours of 8:30 a.m. and 5:00 p.m.
on weekdays in those parking spaces designated as "VGNP Garage Permit
Parking Only" unless there is affixed to said motor vehicle a valid
garage parking permit issued by the Village Clerk.
B.
In those parking spaces designated as "VGNP Garage Permit Parking Only" in Parking Field No. 5, no person shall park a motor vehicle during the hours of 8:30 a.m. to 5:00 p.m. on Mondays through Saturdays unless there is affixed to said motor vehicle a valid parking permit issued by the Village Clerk pursuant to Village Code § 151-8A or C.
A.
Parking permits for the municipal garages shall be issued to any person who has his or her primary place of employment within the Village of Great Neck Plaza, according to the available space. Such a permit may only be used during the hours said person is at his or her place of employment, and such a permit shall only be issued for a motor vehicle which satisfies the conditions specified in Subsection E below.
B.
Parking permits for the municipal garages shall be issued to any person who has his or her primary place of employment in a retail business or office within the Village of Great Neck Estates South of Cedar Drive on Middle Neck Road, Maple Street or Elm Street, according to the available space. Such a permit may only be used during the hours said person is actually at his or her place of employment, and such a permit shall only be issued for a motor vehicle which satisfies the conditions specified in Subsection E below.
C.
Parking permits for the municipal garages shall be issued to those persons who reside in multiple dwellings within the Village of Great Neck Plaza, according to the available space. Only one such residential permit shall be issued per household, and such a permit shall only be issued for a motor vehicle which satisfies the conditions specified in Subsection E below.
D.
Parking permits for the municipal garages shall be issued to persons other than those described in Subsections A, B and C hereof if there is space available after the issuance of permits to the persons described in Subsections A, B and C. Such a permit shall only be issued for a motor vehicle which satisfies the conditions specified in Subsection E below. No more than one such permit shall be issued to any person.
E.
Motor vehicle ownership or lease.
F.
Parking permits for Parking Field No. 5 may be issued
to the employees of retail businesses operating in the village. Only
one such permit shall be issued per business, and such permits shall
be issued on a first-come-first-served basis, according to the available
space.
G.
Parking permits for Municipal Parking Field No. 5 may be issued to
residents of the Village. Such permits shall be issued on a first-come
first-served basis according to the available space.

I.
The Village Board of Trustees, in its sole and absolute discretion,
may by resolution periodically modify the number of permits that shall
be issued to each designated category of permit user in the various
municipal parking fields and garages and shall, if necessary, designate
the precise location of the designated spaces for each category of
permit user.

A.
Applications for permits shall be submitted to the Village, in writing,
on forms to be approved by the Board of Trustees. A copy of the car
registration and applicant's driver's license must accompany the application,
and, depending on the type of permit, there shall also be submitted
either proof of legal residence, a signed statement from the applicant's
employer accompanied by a payroll identification or a signed copy
of a lease.
C.
Effective July 1, 2023, the fees for a permit under § 151-8B shall be as follows:

D.
Effective July 1, 2023, the fees for a permit under § 151-8D shall be $300 per quarter.

E.
Any of the fees set forth herein may hereinafter be periodically
increased by resolution of the Board of Trustees.
F.
Except for permits issued under § 151-8D hereof, where an applicant pays a fee for three months but returns said permit before said three months have elapsed, said applicant shall be entitled to a pro rata refund for each full month remaining in said three-month period. There shall be no refunds with respect to permits issued under § 151-8D.
Permits will be effective for a three-month
period commencing January 1, April 1, July 1 and October 1. Permits
will be issued or renewed at the Village Hall on a quarterly basis
from 10 business days before the end of each quarter until 10 business
days after the end of said quarter, only between the hours of 9:00
a.m. and 10:00 a.m. and 12:00 noon and 1:00 p.m., Mondays through
Friday. A permit is valid only in the municipal garage or parking
field for which it is issued.
A.
A car pool permit shall be issued to an applicant
where two or more persons travel to work together to the Village of
Great Neck Plaza in one vehicle. A car pool permit may list one vehicle
for each person in the car pool up to a maximum of three cars on one
permit.
B.
Registration for each car on a car pool permit must
be shown at the time of application therefor, and each owner's name,
address, license plate number and make of car must be recorded in
the Village Hall.
C.
Applicants for a car pool permit must meet the same eligibility requirements as those contained in § 151-8 hereof.
D.
Where an applicant has two cars, he or she may apply
for a car pool permit.
When a vehicle is temporarily inoperable and
another vehicle is being used in its place, a temporary permit shall
be issued. Temporary permits will be issued at the Village Hall between
those hours to be designated by the Village Clerk.
Except in emergencies, no repairs, washing,
vacuuming or servicing shall be made to any vehicle parked in a municipal
garage or parking field.
A.
Speed limit. No person shall operate a motor vehicle
in a municipal garage or parking field at a speed in excess of 10
miles per hour.
B.
Entrance and exit. No person shall drive a vehicle
into a municipal garage except on an access driveway on the right
side of which there is posted a sign bearing the legend ENTRANCE.
No person shall drive a vehicle out of a municipal garage except on
an access driveway on the right side on which there is posted a sign
bearing the legend EXIT. No person shall drive a vehicle out of a
municipal garage without bringing the vehicle to a complete stop before
crossing the adjoining sidewalk or, if there be no adjoining sidewalk,
before crossing the adjoining curbline.
A.
The Village Clerk may cancel a permit issued hereunder
if she finds that there was a misstatement of some material fact in
the application for the permit.
B.
Depending on the kind of permit, a permit issued hereunder under § 151-8 shall be canceled if the person who obtained the permit no longer works within the Village of Great Neck Plaza, no longer works within the specified areas of the Village of Great Neck Estates, no longer lives at a multiple dwelling within the Village of Great Neck Plaza or no longer commutes from the Village of Great Neck Plaza.
C.
Any permit issued under this article shall be canceled
if the permit is displayed on a vehicle other than the one for which
it was issued, is altered in any way, is illegible or is incorrectly
displayed on a vehicle or if the motor vehicle for which the permit
is issued is sold or transferred.
D.
Where a permit is canceled, the Village Clerk may
demand the return of said permit or may affix to the permit a sticker
bearing the legend void or canceled.
A.
Motor vehicles parked in a municipal garage or parking
field shall be parked within the designated lines only, with the front
of the vehicle facing into the closed end of the parking space. A
parked motor vehicle shall be pulled up as far forward in its parking
space as the wall or wheel stop in the front thereof permits and shall
not be permitted to protrude into the roadway giving access thereto
or to overlap into an adjoining parking space. The parking of motor
vehicles in places other than in the parking spaces indicated is prohibited.
All vehicles shall be securely locked at all times while parked.
B.
Commercial vehicles shall be parked only in designated
spaces on the top level of each municipal garage.
Any person parking a vehicle in a municipal
garage or parking field does so entirely at his or her own risk. Neither
the Board of Trustees nor its agents or employees assume any responsibility
for the safekeeping of the vehicle or any property therein.
A.
Any and all summonses, parking tickets and uniform
traffic tickets issued for a violation of this article shall be returnable
before the Village Justice of the Village of Great Neck Plaza. Any
and all fines levied for a violation of this article shall be paid
into the treasury of the Village of Great Neck Plaza.
B.
Any person who violates any provision of this article
shall be guilty of committing a traffic infraction. Upon conviction
of such a violation, said person shall be punished by a fine of not
more than $250 or by imprisonment for not more than 15 days, or by
both such fine and imprisonment.
