[HISTORY: Adopted by the Board of Trustees of the Village of Great Neck Plaza 11-18-1987 as L.L. No. 16-1987. Amendments noted where applicable.]
The Board of Trustees hereby finds that, in order to enhance the public health, welfare and safety of the residents of the village, it is necessary and desirable to prevent and reduce the unnecessary emission of exhaust fumes by motor vehicles within the village.
As used in this chapter, the following terms shall have the meanings indicated:
MOTOR VEHICLE
Any truck, van, bus or any motor vehicle with a commercial license plate operating within the village.
A. 
No person driving or in charge of a motor vehicle within the village shall allow the engine of such motor vehicle to continue running for a period in excess of five minutes during which period such motor vehicle is stationary. This prohibition shall apply regardless of whether or not the motor vehicle is attended by a driver while it is stationary.
B. 
The prohibition set forth in Subsection A shall not apply:
(1) 
To any period of time during which a motor vehicle is stationary by reason of traffic congestion or delay; or
(2) 
If it is necessary that, even though the motor vehicle is stationary, the engine remain running in order to allow the motor vehicle to perform its function (e.g., if necessary to allow the mixer on a cement truck or the controls of the crane to operate, etc.).
The first violation of this chapter by any motor vehicle within any three-month period shall be punishable by a fine not to exceed $25. The second such violation by the same truck or van or vehicle within any three-month period shall be punishable by a fine not to exceed $75. Any such subsequent violation within any three-month period shall be punishable by a fine not to exceed $250 or by a period of imprisonment not to exceed 15 days, or both.
