This chapter shall be enforced by a Building Inspector and/or one or more Assistant Building Inspectors, as deemed necessary. All such Inspectors shall be appointed by the Town Board.
Whenever the Building Inspector of the Town of Haverstraw shall determine that a violation of this chapter has occurred, he shall issue an order to remove violation.
A. 
Notice. Such order to remove violation shall be sent by the Building Inspector through regular mail, addressed to the owner of record of such land at the address shown on the last preceding assessment roll of the Town.
B. 
Content of order. The order to remove violation shall direct the owner to remove the violation within 30 days of the mailing of the order. The order to remove violation shall specify:
(1) 
The section of the chapter which has been violated.
(2) 
The particulars as to the violation.
(3) 
A statement that the violator has 30 days to appeal the order to remove violation of the Building Inspector to the Zoning Board of Appeals.
(4) 
A statement that, upon failure to correct the violation or receive a favorable determination from the Zoning Board of Appeals, the violator shall be prosecuted to the fullest extent of the law.
C. 
Court appearance. If the thirty-day time period under the order to remove violation expires without the violator's abating the violation or making application to the Zoning Board of Appeals for relief, then the Building Inspector, in cooperation with the Police Department, shall serve a court appearance ticket and a notice of violation of this chapter on the violator.
(1) 
Content of court appearance ticket. The court appearance ticket in conjunction with the notice of violation of this chapter shall state:
(a) 
The section of the chapter which has been violated.
(b) 
The particulars as to the violation.
(c) 
The date and time for appearance in the Justice Court.
(2) 
The Building Inspector may, in his discretion, issue court appearance tickets in any situation where he believes the health, safety and welfare of the public is imminently endangered by a violation. In such situations, the thirty-day notice period is inapplicable. If the Building Inspector issues court appearance tickets under this Subsection, he must document, in the file of the property, his reasons for believing the health, safety and welfare of the public is imminently endangered.
(3) 
Continuing violations. In the event a violator, after receiving an order to remove violation, corrects the violation within the thirty-day period but recreates the violation thereafter, then said original violation shall be considered in effect and a continuation of the earlier violation. In such instances, court appearance ticket(s) shall be issued immediately against the violator.
