The Chief of Police or any police officer attached to the Police Department of the Town of Canton may remove or cause to be removed from any highway located within the Town any vehicle obstructing said highway which has been parked or abandoned on said highway or which has apparently been involved in an accident and is a menace to traffic and may take that vehicle into his custody and may cause the same to be taken to be stored at a suitable place. There shall be no liability attached to such officer or to the Town of Canton for any damage to such motor vehicle while in his custody. All charges necessarily incurred by such officer in the performance of such duty shall be a lien upon such vehicle, and the owner thereof shall pay such costs. The registered owner of the vehicle so parked shall be presumed to be the operator thereof and prima facie guilty of having parked unlawfully. Only such garage owners or other persons in the business of car towing as have caused the Town of Canton to be named as an additional assured on a public highway liability insurance contract with coverage of at least $100,000 for one person, $300,000 per accident, and $100,000 property damage shall be eligible to be retained by the Chief of Police or police officer for the purpose of said removal.
