Loitering — See Ch. 332.
No person shall drink any alcoholic beverages as defined in MGL c. 138, § 1, while on, in or upon any public way to which the public has right of access, any public park, playground, conservation area, cemetery, parking lot, municipal buildings and the grounds appurtenant thereto.
A violation of this bylaw shall be deemed a breach of the peace.
Nothing herein shall be construed to prohibit the duly licensed use and consumption of said liquors as provided by law, or the use and consumption of said liquors in or upon private property or dwellings as may be permitted by law.
A. 
Any person convicted for violation of this bylaw shall be punished by a fine not to exceed $300 for each offense.
B. 
Violations of this bylaw may be enforced via the noncriminal disposition provisions set forth in Chapter 277, Article II, of the Code of the Town of Plainville, in which case the penalty for any such violation shall be $50. The enforcing person(s) shall be the police.
