A. 
Co-mingled recyclables.
(1) 
It shall be mandatory for all owners, lessees and occupants of residential property, except those exempted by reason of physical disability, business and industrial property and private, public or governmental institutions and buildings to recycle by commingling the following items:[1]
(a) 
Glass bottles.
(b) 
Glass jars.
(c) 
Aluminum.
(d) 
Tin.
(e) 
Bimetal cans.
(f) 
Plastic containers, excluding those which had contained cooking and motor oil.

(2) 
Evidence of physical disability shall be submitted to the Township Clerk by the owner, lessee or occupant of residential property and subject to the approval of the Township Committee prior to exemption approval.
B. 
Separated recyclables. It shall be mandatory for all owners, lessees and occupants of residential property, except those exempted by reason of physical disability in accordance with Subsection A of this section, business and industrial property and private, public or governmental institutions and buildings to recycle by separating the following items:[2]
(1) 
Leaves.
(2) 
Newspapers.
(3) 
Magazines.
(4) 
Corrugated cardboard.
(5) 
High-grade paper.
(6) 
Cooking oil.
(7) 
Motor oil. In accordance with N.J.A.C. 14A:3-11, all service stations, oil retailers and motor vehicle reinspection stations with used oil holding tanks shall accept up to five gallons at a time of used motor oil from individuals changing oil from cars, lawn mowers or motorcycles and shall post a sign informing the public that they are a used oil collection site.
(8) 
All junk mail, inclusive of mail delivered via the United States Post Office.

C. 
Demolition materials produced by residential and nonresidential establishments.
(1) 
The Construction Official of the municipality shall issue construction and demolition permits only after the applicant has identified disposal and recycling arrangements. The applicant shall provide appropriate records documenting the quantity and disposition of all materials.
(2) 
A deposit of 10% of the construction and demolition permits shall be required upon issuance of the permit and held in an interest-bearing account until such time as documentation is produced to the satisfaction of the municipality.
(3) 
The municipality shall have the discretion to grant exemptions to a small quantity generator engaged in minor home improvements.
(4) 
A certificate of occupancy shall not be issued until proper disposal documentation has been submitted.
(5) 
An administrative fee of 20% of the deposit moneys shall be retained by the municipality.
D. 
Refrigerators, air conditioners and freezers.

(1) 
Dropoff accommodations shall be made for the disposal of refrigerators, air conditioners or freezers at the recycling center, 39 Leocadia Court. A fee of $25 will be charged. Check only and made payable to the Township of Hazlet.
E. 
Mulch. The Township will no longer offer mulch to the residents of Hazlet.

As used in this article, the following terms shall have the meanings indicated:
ALUMINUM
Includes all disposable items made of aluminum, including containers used for soda, beer or other beverages, foil, wrappers, containers for prepared food, screen frames and lawn chairs.
CORRUGATED CARDBOARD
Includes cardboard of the type used to make cardboard boxes, cartons, pasteboard and similar corrugated and kraft paper material.
DEMOLITION MATERIALS
Includes all unusable asphalt, concrete and wood waste generated by the construction, reconstruction, remodeling, demolition or destruction of any building or structure or any street, parking lot, driveway, sidewalk, walkway, fence or other thing associated with any building or structure.

GLASS
Includes all products made from silica or sand, soda ash and limestone; the product being transparent or translucent and being used for packaging or bottling of various matters; excluding, however, blue or flat glass commonly known as "window glass."
HIGH-GRADE PAPER
Includes white and/or off-white stationery, photocopy and computer paper.
SOLID WASTE
Includes all garbage and rubbish normally produced by the occupants of commercial, industrial and residential property and disposed of by private or public pickup.

A. 
The position of Recycling Coordinator is hereby created in the Department of Public Works as a part-time position for the purposes of carrying out the responsibilities of this article.
B. 
The Recycling Coordinator appointed by the Township Committee shall be a municipal certified recycling coordinator as per P.L. 2007, c.311 (c.13: 1-E-96.2 et al) and he or she shall receive the compensation as provided for this position in the Township's Salary Ordinance,[1] provided that nothing contained herein shall prevent an existing full-time Township employee from performing these duties and receiving the compensation provided for this position in the Township's Salary Ordinance.

C. 
The Township Committee or Recycling Coordinator, subject to the review of the Township Committee, shall establish and promulgate reasonable rules and regulations as to the manner, days and times for the collection, assorting, transportation, sale and/or marketing of said recyclable materials in order to encourage the preservation of material resources by minimizing the cost of the recycling program in the Township of Hazlet.

A. 
The Township Committee may use municipal personnel to collect recyclable material set forth at curb and/or from a dropoff center and shall sell said recyclable material if market exists therefore pursuant to N.J.S.A. 40A:1 1-1 et seq. The material collected at curbside and/or at the dropoff center shall remain the property of Hazlet Township and Hazlet Township receives the proceeds from the sale of collected recycled materials.
B. 
The Township Committee may elect to enter into agreements with any person, partnership, corporation or municipality for them to collect said material at curbside and/or from a dropoff center and sell said recycled material. The recycled material collected at curbside and/or dropoff center shall remain the property of Hazlet Township and Hazlet Township receives the proceeds from the sale of collected recycled materials.

A. 
Recyclable material to be collected by municipal personnel or such other authorized party pursuant to this article shall be placed at curbside in accordance with § 145-1B of this Code.
B. 
All recyclable material shall be placed in the recycling container provided by Township.
C. 
Lost of stolen recycling containers. It shall be the responsibility of the homeowner to replace the container at the prevailing rate.
D. 
Upon the sale of a residence, it shall be the responsibility of the homeowner to return the recycling container to the Department of Public Works. If the container is not returned, a continued certificate of occupancy will not be issued.
E. 
Any violation of this article shall be punishable in accordance with § 347-8 of this article.
A. 
Recyclable material as defined herein shall be the property of the Township of Hazlet once placed on the curbside or brought to a dropoff center.
B. 
It shall be a violation of this article for any person unauthorized by the Township of Hazlet to pick up or cause to be picked up said recyclable material as defined herein. Each such collection in violation hereof shall constitute a separate distinct offense punishable as hereinafter provided.
A. 
Anything herein to the contrary notwithstanding, any person, partnership or corporation who is owner, lessee or occupant of a residential or nonresidential property may donate or sell said recyclable material as defined herein to any person, partnership or corporation, whether or not operating for profit. Said person, partnership or corporation, however, shall not pick up said recyclable materials at curbside or at a municipal dropoff center.
B. 
Any person or entity using a direct disposal method and any person, partnership or corporation engaging in the business of direct disposal shall, on a quarterly basis, without costs to the Township of Hazlet, report the weight of each recyclable material disposed of or collected to the Township's Recycling Coordinator so that accurate reports can be filed by the Township with the County of Monmouth.

A. 
Any person, firm or corporation who violates or neglects to comply with any provision of this article or any rule or regulation promulgated pursuant thereto shall be fined as follows:

(1) 
First offense: $100.
(2) 
Second offense: $200.
(3) 
Third offense: up to $1,000.
B. 
Each day such violation or neglect is committed or permitted to continue shall constitute a separate offense and be punishable as such.

The enforcement of the provisions of this article and rules and regulations promulgated pursuant thereto shall be the responsibility of the Code Enforcement Officer.

It shall be mandatory that all businesses located and transacting business within the Township of Hazlet generating recyclable materials file or cause to be filed the required recycling reports under this article, the failure of which to do so shall subject the business to the penalties as prescribed as follows:
A. 
During the first year, $250 for the first offense and $500 for second and subsequent offenses.
B. 
For the second and subsequent years, $500 for the first offense and $750 for second and subsequent offenses.
Any business that does not file the required report within five days of the deadline shall be in violation of this article and, if nonregistered, the business will be fined in accordance with the provisions of this article and Chapter 249, Licensing.
The reporting shall be on a questionnaire provided by the Township of Hazlet to all affected businesses.
