Every sidewalk and curb in the Township constructed,
reconstructed or repaired by an abutting owner shall be done in a
good and workmanlike manner at the expense of the owner. All new sidewalks
shall not be less than four feet in width, unless otherwise permitted
by the Township Committee. Curbs shall have a minimum width at the
top of six inches, at the bottom of eight inches and have a minimum
depth of 18 inches.
A.
All new sidewalks constructed by an owner shall be
constructed in accordance with the line and grade established by the
Township Engineer. All old or existing sidewalks reconstructed or
repaired by an owner shall be reconstructed or repaired in accordance
with existing line and grade, unless the line or grade is changed
by the Township Engineer. It shall be the duty of the owner in all
cases to make inquiry of the Township Engineer concerning the line
and grade. Where the fill-in is more than one foot, it shall be done
in layers and thoroughly tamped and compacted.
B.
Every sidewalk and curb shall be constructed, reconstructed
or repaired in accordance with specifications prepared by the Township
Engineer.
Every owner, at his or her own cost and expense, shall at all times keep and maintain the sidewalk and curbing abutting his or her property in good condition and state of repair, and shall not permit it to fall into a state of disrepair or to become unsafe or unfit to walk upon. In the event that any sidewalk or curb or any part thereof becomes broken or in need of repair or the condition thereof becomes unsafe or hazardous to the public or unfit to walk upon, the owner shall, as soon as possible, reconstruct or repair, as the case may require, the sidewalk or curb or that part thereof which needs reconstruction or repair. The improvement or work shall be done in accordance with the provisions of §§ 392-8 and 392-9 of this article.

In the event that an owner fails to reconstruct
or repair his or her sidewalk or curb or any part thereof as may require
reconstruction or repair, as provided in this article, the Township
Committee may cause the improvement or work to be made under the supervision
of the Township Engineer or may award a contract therefor, and the
cost thereof assessed upon the property of the owner in accordance
with N.J.S.A. 40:65-14.

For violation of any provision of this article, the maximum penalty, upon conviction, shall not exceed the maximum penalties set forth in Chapter 1, General Provisions, Article III. Each and every violation of any provision of this article shall be considered a separate violation and shall subject the person so charged to the maximum penalty.
