There is hereby established the position of
Defense Counsel.
A suitable member of the Bar of the State of
New Jersey shall be appointed annually to the position and for a term
of one year by the Mayor with the advice and consent of the Council.
In any instance in which the Borough has the
statutory duty to make defense counsel available to a member of the
Police Department in a Municipal Court matter, Defense Counsel shall
serve in that capacity. Any member of the Police Department shall
have the right, at his/her own expense, to engage defense counsel
of his/her own choosing.

Defense Counsel shall be paid by the Borough
the sum of $150 per hour.
