Any animal of the genus equus, which is being lawfully kept in the Borough of North Haledon, shall be kept in accordance with the provisions of this article.

The owner of any animal of the genus equus in North Haledon shall register the animal with the Borough Clerk on a form to be provided by the Borough, together with a registration fee as provided in Chapter 275, Fees, for each registrant, to be paid annually. No person shall keep an animal of the genus equus in the Borough of North Haledon which has not been registered. Before such registration shall be accepted by the Borough Clerk, the owner or keeper shall submit written evidence that the keeping of the animal is pursuant to a valid subsisting nonconforming use or is otherwise in compliance with Chapter 600, Zoning.
Before the Borough Clerk shall issue a registration, the application shall be submitted to the Sanitary Inspector of the Board of Health of the Borough. The Sanitary Inspector shall make an inspection of the premises. If, in the opinion of the Sanitary Inspector, a percolation test or soil log test is necessary or appropriate, the applicant shall have such percolation or soil log test performed and shall submit the certified written results to the Sanitary Inspector for his/her review. The Borough Clerk shall not issue the registration unless the Sanitary Inspector has certified, in writing, that he/she has made an on-site inspection and finds the site to be in compliance with the requirements of this article and that the granting of the registration would not create a health hazard. Upon receipt of such a certification from the Sanitary Inspector, the Borough Clerk shall issue the registration so long as the premises complies with all of the applicable ordinances of the Borough.
The applicant must provide suitable housing for the animal or animals, which shall be completely enclosed and subject to the following conditions:
A. 
At its closest point, such housing shall be at least 100 feet from the closest point of any dwelling.
B. 
The premises shall, at all times, be kept in a sanitary condition so as to prevent the breeding of flies, vermin or other insects or the contamination of wells, springs, streams or swamp areas.
C. 
All areas where the animal or animals are kept shall be treated and maintained in such a manner as to prevent odor and the attraction of insects or rodents.
D. 
Floors must be constructed in a manner which will provide for easy cleaning and for the proper disposal of urine and other liquid waste. All such floors must be acceptable to and approved by the Sanitary Inspector.
E. 
Manure must be picked up daily, and the building must be thoroughly cleaned daily.
F. 
All buildings where animals are kept shall be provided with a preventative procedure to eliminate flies, insects and rodents, the procedure being subject to the approval of the Sanitary Inspector.
All premises on which the animals are kept shall be subject to the following conditions:
A. 
Manure shall be cleaned up daily.
B. 
Manure must be stored in flyproof and waterproof containers.
C. 
Feed must be stored in metal containers with tight-fitting metal covers.
D. 
The surface must be maintained to prevent dust conditions.
All animals of the genus equus kept in the Borough must be free of sickness and disease. The Sanitary Inspector shall have the right to require an examination by a doctor of veterinary medicine and the submission of a certificate from the doctor. The examination and the furnishing of the certificate shall be at the expense of the applicant.
The owner or keeper of an animal of the genus equus shall be required to comply with such additional requirements as may be ordered by the Sanitary Inspector of the Borough to ensure public health.

Any owner or keeper of an animal of the genus equus who shall violate any of the provisions of this article shall, upon conviction, be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty. Each day that a violation is permitted to exist shall constitute a separate offense.

Structures and premises used for the housing and/or keeping of animals of the genus equus lawfully existing and used in the Borough at the time of passage of this article shall be exempt from compliance with § 202-16A only, provided that such structures and premises do not create a public health nuisance or public health hazard.
