As used in this article, the following terms shall have the meanings indicated:
ALUMINUM CANS
Cans made entirely of aluminum which were used to hold beverages. Specifically excluded are cans of other types of materials and other aluminum products such as foil, pie pans, and aluminum siding.
AUTOMOTIVE BATTERIES
Any vehicle battery.

BUSINESS and COMMERCIAL
Any nonresidential building or establishment, including, but not limited to, those used for retail, wholesale, offices, professional services, shipping and receiving areas and cafeterias.
CONSTRUCTION/DEMOLITION DEBRIS
Recyclable components of the construction/demolition debris waste stream, including but not limited to concrete, brick, block, asphalt, asphalt-based roofing scrap, lumber products, sheet rock and tree stumps/trunks.

CORRUGATED CARDBOARD
The term used to identify a type of paper in which a portion has been made to have a wavy surface (alternating ridge and grooves) and is placed between two flat surfaces for the sake of strength and which is commonly used to form cartons.
DESIGNATED MATERIALS
Those recyclable materials listed in the Passaic County District Recycling Plan which are mandated to be sources separated for recycling; namely, glass food and beverage containers, aluminum beverage containers, newspaper and leaves residentially; glass food and beverage containers, aluminum beverage containers, and corrugated cardboard for restaurants and taverns; corrugated cardboard and high-grade paper for all other commercial establishments; and glass food and beverage containers, aluminum beverage containers, corrugated cardboard and high-grade paper for institutional establishments. Also included are tires.
FERROUS AND NONFERROUS SCRAP METALS
Scrap metals other than household appliances, including but not limited to steel, cast iron, aluminum, brass, fencing and yard equipment.

GLASS
Bottles and jars made of silica, soda ash and limestone, being transparent or translucent and breakable. Specifically excluded are plastics, or any other glass products such as window glass and ceramics.
HIGH-GRADE PAPER
Papers generally used in offices that are of high quality and do not have a glossy finish, including but not limited to computer, letterhead, ledger and photocopy paper.
HOUSEHOLD APPLIANCES
Stoves, washers, dryers, dishwashers, water heaters, refrigerators, sinks, tubs and freezers, and all other items of a similar nature.

INSTITUTION
An established organization or foundation dedicated to public service or culture, including but not limited to religious, educational, health care, and governmental establishments.
LEAVES
The term as used herein shall be deemed to refer to fallen leaves.
MIXED PAPER
Magazines, junk mail and unsoiled scrap.

MOTOR OIL
Used engine oil.

PLASTICS
Milk, soda, detergent and food container bottles only, excluding plastic wrappings, toys, bags, HDPE, PET, PVC and any other type of plastic.
RECYCLING
Any process by which materials which would otherwise become solid waste are collected, separated or processed and returned to the economic mainstream in the form of raw materials or products.
RESIDENT
Any person who owns, leases and/or occupies dwellings within the municipality, including those in multifamily dwellings and/or single-family developments.
RESTAURANT and TAVERN
Any nonresidential building or establishment, including, but not limited to, those used for providing food-related and dining services.
SOLID WASTE
Refers to all garbage and rubbish normally placed at the curb for collection by the Borough on a regular schedule.
SOURCE SEPARATION
Recyclable materials which are kept separate and apart from residential, commercial and institutional solid waste by the generator for the purposes of collection, disposition and recycling.
TIN AND BIMETAL CANS
Includes all metal containers other than aluminum.

TIRES
New and used tires.

The following are designated as recyclable materials in the Borough of North Haledon: newspaper, glass food and beverage containers, aluminum beverage containers, tin and bimetal cans, plastic containers and film (PET, HDPE and PVC), corrugated cardboard, mixed paper, high-grade paper, leaves, white goods, ferrous and nonferrous scrap metals, construction/demolition debris, tires, motor oil and automotive batteries.
Each designated recyclable shall be prepared by each person in the manner hereinafter described prior to leaving the same at the recycling center or placing at curbside:
A. 
Newspapers shall be tied in bundles no more than 12 inches high or shall be placed in paper grocery bags. Packaging in plastic bags is not permitted.
B. 
High-grade wastepaper shall be placed in paper grocery bags.
C. 
Corrugated cardboard shall be cut and folded to reduce volume as much as possible and tied with cord in bundles no greater than 12 inches in height.

D. 
Glass shall be thoroughly rinsed to remove all beverage/food residue and waste, and the caps shall be removed. Labels may remain on the glass.
E. 
Aluminum cans shall be thoroughly rinsed to remove all beverage and/or food residue and waste.
F. 
Tin cans shall be thoroughly rinsed to remove all beverage and/or food residue and waste.
G. 
Plastics shall be thoroughly rinsed to remove all beverage and/or food residue and waste.
H. 
Leaves shall be raked to the curb for collection by the Department of Public Works during time periods designated by the governing body of the Borough of North Haledon. At and during all other times, take in reusable containers and deposit at the recycling center compost area during the normal hours of operation.

It shall be mandatory for all persons to separate recyclable material, as designated by § 510-9 of the Code of the Borough of North Haledon, from their household, business, commercial or institutional waste.
A. 
Residents shall separate recyclable material, as designated by § 510-9 of the Code of the Borough of North Haledon, and shall place the same at the curb for collection on such dates as designated by the governing body of the Borough of North Haledon or shall deposit same at the recycling center located at Willow Brook Court between the hours of 8:00 a.m. and 4:00 p.m., Monday through Saturday. All recyclable material shall be prepared in accordance with § 510-10 of the Code of the Borough of North Haledon. All of the aforementioned provisions may from time to time be modified by the governing body of the Borough of North Haledon.
B. 
Residential developments (multifamily and single-family) shall be responsible for establishing recycling programs for the collection of designated recyclable materials listed in § 510-9. These materials are to be stored for collection by the municipality, a private recycling vendor or deposited at the municipal recycling depot. Documentation of tonnage of material recycled is to be submitted in accordance with Subsection F.
C. 
Each commercial and industrial establishment shall perform a self-audit waste survey in the following phased-in manner, with waste reduction plans to be submitted to the County Recycling Coordinator and also to the Municipal Recycling Coordinator:
(1) 
Businesses with more than 500 employees: immediately;
(2) 
Businesses with more than 250 employees: by 1993;
(3) 
Businesses with more than 100 employees: by 1994; and
(4) 
Businesses with more than 50 employees: by 1995.
D. 
Institutions shall source and separate recyclable material as designated by § 510-9 of the Code of the Borough of North Haledon. Designated materials may be deposited at the recycling center during regular hours if prepared in accordance with § 510-10 of the Code of the Borough of North Haledon. Otherwise, the institution shall be responsible for establishing recycling programs for the collection, transportation and marketing of designated recyclable materials. Documentation of tonnage of material recycled is to be submitted in accordance with Subsection F.
E. 
Business and commercial establishments shall source and separate recyclable material as designated by § 510-9 of the Code of the Borough of North Haledon. Designated materials may be deposited at the recycling center during regular hours if prepared in accordance with § 510-10 of the Code of the Borough of North Haledon. Otherwise, the business or commercial establishment shall be responsible for establishing recycling programs for the collection, transportation and marketing of designated recyclable materials. Documentation of tonnage of material recycled is to be submitted in accordance with Subsection F.
F. 
All commercial, institutional, multifamily or single-family developments which are not serviced by municipal recycling collection systems must submit recycling documentation, including type and tonnage of waste recycled, on a quarterly basis to the Municipal Clerk. Due dates for report periods:

G. 
Construction or demolition debris; documentation.
(1) 
On and after final approval and the effective date of this section, it shall be both mandatory and a condition precedent to the issuance of any permanent certificate of occupancy or final work inspection of the owner of such property to recycle all applicable construction or demolition debris components and to provide written proof of same in accordance with the provision set forth hereinbelow to the Building Department or transmittal to the Recycling Coordinator. If the property owner is otherwise entitled to a certificate of occupancy except for the submission of the written proof required by this section, the Construction Official shall issue a temporary certificate of occupancy for a period of 90 days, and, upon the receipt of the written proof, the permanent certificate of occupancy shall issue.
(2) 
Written documentation of the tonnage of material recycled under this subsection shall be made by accurate weight slips as will satisfy state requirements for municipal eligibility for state tonnage grants. In the event the property owner demonstrates to the satisfaction of the Mayor and Council that he/she has made a good faith effort to obtain the written evidence but has not obtained it, the Mayor and Council shall have the discretion to waive the requirements.
This article is in no way intended to prohibit separate newspaper drops or other recycling drives by volunteer or charitable organizations approved by the Borough of North Haledon on days other than those designated for collection by the Borough. Such an organization must get a written permit from the Borough Clerk's office prior to conducting any newspaper drop or other recycling drive. Weight receipts from all sales of designated recyclable materials, whether by the Borough or a duly authorized volunteer or charitable organization, must be submitted to the Borough no later than 30 days after the collection.

The governing body of the Borough of North Haledon is hereby authorized and directed to establish and promulgate reasonable regulations as to the manner, days and times for the collection of designated recyclable materials in accordance with the terms hereof. The governing body of the Borough of North Haledon may, by majority vote, change, modify, repeal or amend any portion of said rules and regulations.

A. 
Any person who violates this article by collecting or picking up or causing to be picked up any designated recyclable material, upon conviction thereof, shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty.[1]

B. 
Any unlawful dumping of recyclable materials at the recycling center or anywhere within the jurisdiction of the Borough shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty.[2]

C. 
Any person who violates any of the other terms of the within article shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty. The governing body may, by resolution, require that the Borough's scavenger inspect trash for the presence of designated recyclable materials. If designated recyclable materials are found, the scavenger shall be authorized to leave the same at the curbside and place a warning sticker on the container, and the person shall be responsible for separating the recyclables before the next collection date.

D. 
No provision of this article shall be construed to impair any common law or statutory cause of action or any other legal remedy, including but not limited to any other violations provided by the ordinances of the Borough of North Haledon for any violation(s) thereof.

The provisions of § 510-11D and E become effective April 1, 2009. All other provisions of this article shall become and/or remain effective immediately.

This article shall be enforced by any duly designated agent or officer authorized by resolution of the governing body of the Borough of North Haledon.

Tires may be disposed of at the recycling center by stacking the same in the appropriately designated area and upon payment of the appropriate fee as provided in Chapter 275, Fees.

Any person who is an owner, lessee or occupant may donate or sell recyclable materials to any person, partnership, or corporation (whether operating for profit or not for profit), as long as the recycling individual or company submits documentation to the Municipal Recycling Coordinator as described in § 510-11F.

A. 
It shall be unlawful to combine designated, unsoiled recyclables with other solid waste. Failure to source-separate designated materials for recycling is a violation of this article.
B. 
It shall be unlawful for solid waste collectors to collect solid waste that contains visible signs of designated recyclable materials. It is also unlawful for solid waste collectors to remove for disposal those bags or containers of solid waste/recyclables which visibly display a warning notice, sticker or some other device indicating that the load of solid waste contains designated recyclable material and therefore should not be removed for disposal.
C. 
It shall be the responsibility of the nonrecycler whose solid waste was not removed because it contained recyclables to properly segregate the uncollected waste for proper recycling. Allowing such unseparated refuse to accumulate will be considered a violation of this article.
D. 
It shall be unlawful for the generator not serviced by the municipality for collection of recyclables to fail to accurately record and report recyclables that have been collected, stored, sold or otherwise disposed of.

The governing body may exempt persons occupying commercial and institutional premises located within the Borough of North Haledon from the source-separation requirements of this article if those persons have otherwise provided for the recycling of the designated recyclable materials from solid waste generated at those premises. To be eligible for an exemption, a commercial or institutional solid waste generator must provide appropriate written documentation to the Municipal Recycling Coordinator of the tonnage recycled.

It is prohibited to place grass or grass waste in the regular solid waste collection at any time of the year. Grass and/or grass waste should be stored or composted at the residence where the grass waste is generated. In cases where residents request landscapers to remove grass waste from their residences, it shall be the responsibility of the landscaper to dispose of same.
