No person shall install, construct, erect, operate or maintain a satellite earth station antenna, as hereinafter defined, or cause, suffer or permit the same, on any lot or parcel of land anywhere within the Borough, except in compliance with the provisions of this article.
As used in this article, the following terms shall have the meanings indicated:
SATELLITE EARTH STATION ANTENNA
A parabolic- or dish-shaped antenna, or any other apparatus or device which exceeds three feet in diameter or cross section at its widest point, and which is designed for the purpose of receiving television, radio, microwave or any form of electronic signals, transmitted or relayed directly from space satellite antennas to said device.
Satellite earth station antennas shall be deemed accessory buildings and, unless otherwise herein regulated more strictly, shall be subject to all of the provisions and restrictions, including issuance of a building permit, applicable to accessory buildings generally and in the respective zone district in which the same may be located.
No satellite earth station antenna shall exceed 15 feet in height, nor shall the dish or other attenuation device exceed 11 feet in diameter or cross section when measured at its widest points.
No satellite earth station antenna may be placed on any rooftop or other part or portion of a building or structure in any residential zone. All satellite earth station antennas in residential zones shall be freestanding, and height measurements shall be made from ground level at the base or mount of the antenna.
Every satellite earth station antenna shall be reasonably screened to minimize the view of the antenna from public thoroughfares and the ground level of adjacent properties. Screening may consist of trellis, latticework, decorative block or natural plants, shrubs or trees, not less than six feet in height, and which shall, in the judgment of the Construction Official, be of sufficient density and opacity to provide adequate screening in compliance with the intention of this section. This shall be a continuing requirement, and such screening shall be maintained as originally approved or upon adequate notice in the manner provided for building and zoning violations.
The Construction Official may revoke the permit and thereafter proceed to enforce this article in the same manner as other violations or unlawful structures.
All satellite earth station antennas shall be designed in conformance with the American National Standards Institute Standard A48-1, American National Standard Building Code Requirements for Minimum Design Loads in Building and Other Structures, and the Electronics Industry Association Standard RS-411, Electrical and Mechanical Characteristics of Antennas for Satellite Earth Stations, or any modification or successors to said standards, as well as any other construction or performance standards, rules and regulations of any governmental entity having jurisdiction over such antennas, including, without limitation, the Federal Communications Commission. A certificate of conformance with the aforesaid standards by the manufacturer's professional personnel or such other professional as may be deemed appropriate by the Construction Official shall be submitted to the Construction Official as a condition of the issuance of the building permit required by this article.
Every satellite earth station antenna, and receiving or other related apparatus, shall be located on the same lot and shall be for the sole and exclusive use of the building on that lot, and any connection of parts of the apparatus from and between different lots, or use of the same by other lots, shall be a violation of this article.
