A. 
North Hudson Regional Fire and Rescue. Fire protection, rescue and emergency services for Union City is the responsibility of North Hudson Regional Fire and Rescue pursuant to the consolidated municipal services agreement for the formation of a joint meeting entered into by resolution dated December 30, 1998, by the Town of Guttenberg, the Township of North Bergen, the City of Union City, the Township of Weehawken and the Town of West New York as authorized by N.J.S.A. 40:48B-1.
B. 
Local enforcement. Pursuant to Section 11 of the Uniform Fire Safety Act, P.L. 1983, c .383, N.J.S.A. 52:27D-192 et seq., and the Uniform Fire Code at N.J.A.C. 5:70-1 et seq., shall be locally enforced in the City of Union City.
C. 
Agency designation. The local enforcing agency shall be the Fire Prevention Bureau of the City, which is hereby created in the Department of Public Safety.
D. 
Organization of the Fire Prevention Bureau. The Fire Prevention Bureau shall be under the direct supervision and control of the Fire Official or a Fire Prevention Specialist, certified as a Fire Official, who shall report to the Director of Public Safety.
E. 
Appointments; qualifications; term of office; removal.
(1) 
Appointment and qualifications of the Fire Official. The Fire Official and Fire Prevention Specialist shall be certified by the state and appointed by the Director of Public Safety.
(2) 
Appointment and qualifications of inspectors and other employees. Inspectors and other employees of the enforcing agency shall be appointed by the Director of Public Safety upon recommendation of the Fire Official. All life hazard use inspectors shall be certified by the state.
(3) 
Term of office. The Fire Official shall serve for a term of office in accordance with civil service laws, rules and regulations. Any vacancy shall be filled for the unexpired term.
(4) 
Removal from office. The Fire Official, inspectors and other employees of the agency shall be subject to removal by the City for just cause and in accordance with civil service laws, rules and regulations.
(5) 
Appointment of legal counsel. Corporation Counsel is hereby appointed as legal counsel to assist the agency enforcing the Uniform Fire Code.
F. 
Duties. The Fire Prevention Bureau shall enforce the Uniform Fire Code in all buildings, structures and premises within the established boundaries of the City other than one- and two-unit owner-occupied dwellings used exclusively for dwelling purposes and buildings, structures and premises owned or operated by the federal government, interstate agencies or the state, and shall faithfully comply with all the pertinent requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
G. 
Board of appeals. Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208), any person aggrieved by any action of the local enforcing agency shall have the right to appeal to the Hudson County Construction Board of Appeals.
H. 
Enforcement; violations and penalties. Enforcement and violations and penalties shall be managed in conformity with the Uniform Fire Safety Act, the Uniform Fire Code and all other laws of the State of New Jersey.[1]
