Pursuant to the authority conferred by Article 9 of the Town Law of the State of New York and in order to promote the health, safety and general welfare of the residents of the Town of Stillwater, this article has been established to regulate the location, installation, maintenance and use of residential and commercial sanitary sewer connections for all parcels in the Town of Stillwater located within 100 feet of the public sewer line constructed by the Saratoga County Sewer District No. 1 on the easterly side of Saratoga Lake.
The owner of any house, building, or property used for human occupancy, employment, recreation, or other purpose, situated within the Town of Stillwater and located within 100 feet of the public sewer line constructed by the Saratoga County Sewer District No. 1 on the easterly side of Saratoga Lake, is hereby required to install, at his or her expense, suitable plumbing facilities therein, and to connect such facilities directly to the public sewer line constructed by Saratoga County Sewer District No. 1, in accordance with the Town of Stillwater Standard Specifications for Sanitary Sewer Connections.
With regard to new construction, sewer connections shall be made prior to the issuance of a certificate of occupancy, provided that the public sewer is within 100 feet of the property line. All existing structures which are located on parcels located within 100 feet of the sewer line constructed by Saratoga County Sewer District No. 1 shall be connected to said sewer line within six months after the date this article becomes effective, or within three months after the installation of a public sanitary sewer line installed after the effective date of this article, provided that the public sewer is within 100 feet of the property line.
All installation of sanitary sewer connections shall be subject to the control and approval of the Town of Stillwater Zoning Enforcement Officer. Property owners may obtain a sewer connection and permit form and a copy of the Town of Stillwater Standard Specifications for Sanitary Sewer Connections from the Zoning Enforcement Officer or the Town Clerk at the Town Hall.
The sewer connection application fee shall be $10.
Any person who shall violate, or cause to be violated, or assisting the violation of any provision of this article shall be subject to conviction of an offense by a proper court and be subject to a fine of not more than $50 for each and every violation. Each week that such violation continues shall constitute a separate offense. The term "person" as used in this section shall include an owner, occupant, mortgagee, tenant, vendee in possession, assignee of rents, receiver, executor, trustee, lessee, agent or any other person, firm, or corporation directly or indirectly in control of a building, property, or part thereof.
