The previous ordinances or resolutions relating to the Nonuniformed Employees' Pension Plan of East Brandywine Township with an effective date prior to the adoption date of the amendment and restatement of the plan are hereby repealed with respect to benefits accruing on or after the amendment and restatement effective date, and the attached amendment and restatement of the plan is enacted; and further, be it ordained and enacted by East Brandywine Township that the previous ordinances and resolutions relating to the Nonuniformed Employees' Pension Plan of East Brandywine Township Fund with an effective date prior to the adoption date of the amendment and restatement of the Trust are hereby repealed and the attached amendment and restatement of the Trust is enacted.[1]

Scott T. Piersol, Township Manager, is hereby appointed as the Chief Administrative Officer of the plan. Hudson L. Voltz, Chairman of the Board of Supervisors, as the agent of the employer, is authorized and directed to execute the attached amendment and restatement of the plan and the attached amendment and restatement of the Trust. First Financial Bank is hereby confirmed as the Trustee of the Trust.

Editor's Note: The preamble of this ordinance provided the following:
"WHEREAS, the Brandywine Regional Police Commission previously established the Brandywine Regional Police Commission Pension Plan; and
WHEREAS, effective December 31, 2008, the Brandywine Regional Police Commission dissolved; and
WHEREAS, East Brandywine Township desires to become the Plan sponsor and change the name of the Plan to 'East Brandywine Police Pension Plan'; and
WHEREAS, East Brandywine Township, in order to continue compliance with the tax-exempt retirement plan requirements of the Internal Revenue Code of 1986 (as amended), Section 401(a), desires to enact an amendment to the pPlan."
A. 
The attached amendment and restatement of the East Brandywine Township Police Pension Plan is enacted. The Chairman of the Board of Supervisors of East Brandywine Township, as the agent of the employer, is authorized and directed to execute the attached amendment and restatement of the plan.[1]

B. 
The 2009 Compliance Amendment to the East Brandywine Township Police Pension Plan, attached hereto as Exhibit A and incorporated by reference, is hereby adopted. The Chairman of the East Brandywine Township Board of Supervisors, as agent of the employer, is authorized and directed to execute the attached amendment of the plan. All other provisions of the plan not inconsistent herewith shall remain in full force and effect.
