Pursuant to 11 Del. C. § 8805, the
Town has elected to have its qualifying police employees participate
in the pension plan authorized by 11 Del. C. Chapter 88 ("Delaware
County And Municipal Police/Fire fighter Pension Plan"). Effective
July 1, 2006, all qualifying police employees shall be covered by
that pension plan which shall be governed by the provisions of 11
Del. C. Chapter 88 and administered in accordance therewith.
Pursuant to 29 Del. C. § 5555, the
Town has elected to require all other qualifying Town employees to
participate in the pension plan authorized by 29 Del. C. Chapter 55A
("County and Municipal Employees Pension Plan"). Effective July 1,
2006, all qualifying Town employees shall be covered by that pension
plan which shall be governed by the provisions of 11 Del. C. Chapter
88 and administered in accordance therewith.
