The Office of Borough Manager be and the same is hereby created for the Borough of Lewisburg.
Any person who is a citizen of the United States, is at least 21 years of age and has the qualifications and experience necessary to perform the prescribed duties of the Borough Manager, shall be eligible to hold the Office of Borough Manager; provided, however, that neither the Mayor nor any member of the Borough Council shall be eligible to hold such office.
Borough Council shall, at its reorganization meeting, appoint or reappoint, by a majority vote of all its members, one person to fill the Office of Borough Manager.

Unless removed from office as hereinafter provided or as otherwise provided in a written employment agreement with the person appointed as Borough Manager, the Borough Manager shall hold office, subject to such terms and conditions of employment as shall be established, from time to time, by Borough Council or as otherwise provided in a written employment with the person appointed as Borough Manager, until the first Monday of January of the even-numbered year following appointment and until a successor is appointed and qualified.
In the event of a vacancy in the Office of Borough Manager, Borough Council shall appoint, by a majority of all its member, one person to fill said office for the remainder of the then current term.

The Borough Manager shall be subject to removal from office by Borough Council at any time, with or without cause, by a vote of a majority of all of its members.
After initial appointment and before proceeding with the duties of the office, the Borough Manager shall give a bond to the Borough, in at least the sum of the Borough's Highway Aid allocation of $60,000 whichever is less, with a bonding company as surety to be approved by Borough Council, said bond to be conditioned on the faithful performance of duties. The premium on the said bond shall be paid by the Borough.
Under the direction of Borough Council, the Borough Manager shall carry on the business of the Borough and powers and duties shall relate to the general management of all Borough business not expressly imposed or conferred, by statute or otherwise, upon any other Borough Officer. With approval of Borough Council, the Mayor may delegate to the Borough Manager, subject to recall by written notification at any time, any of his non-legislative and non-judicial powers and duties.
The Borough Manager shall have the following specific powers and duties, which shall be subject to change at any time by ordinance enacted by Borough Council:
A. 
Supervision over departments. The Borough Manager shall have direct supervision over and shall be responsible to Borough Council for the administration and operation of the following Borough departments and their employees:
(1) 
Administrative Department.
(2) 
Public Works Department.
(3) 
Solid Waste Department.
(4) 
Planning Department.
(5) 
Code Enforcement Department.
B. 
Representative, administrative and advisory duties. The Borough Manager shall:
(1) 
Represent the Borough in all matters concerning those departments of the Borough over which the Borough Manager has supervision, except as otherwise provided in § 65-10 of this article.
(2) 
Ensure the orderly administration and operation of the Borough and the aforesaid departments.
(3) 
Supervise and direct, as required, the work and performance of the aforesaid departments and all employees thereof.
(4) 
Effect coordination and cooperation among all departments of the Borough, including those not specifically set forth hereinabove.
(5) 
Arrange and attend conferences with any member of Borough Council and proper departmental supervisors in order to resolve complaints, consider suggestions or discuss measures advanced by Borough Council.
(6) 
Attend to the letting of contracts in due form of law and supervise the performance and faithful execution of such contracts, except insofar as such duties are expressly imposed or conferred by statute or otherwise, upon any other Borough officer.
(7) 
Report to Borough Council on all matters of significance, making recommendations when appropriate.
(8) 
Report promptly to Borough Council on any matter beyond the authority of the Borough Manager or the scope of the office for consideration and action by Borough Council.
(9) 
Make such reports to Borough Council upon the affairs and financial condition of the Borough as Council may, from time to time, direct.
(10) 
Supervise the preparation of the agenda for all regular and special meetings of Borough Council.
(11) 
Prepare and submit to Borough Council a tentative budget for the next fiscal year and when Council shall direct.
(12) 
Present annually to Borough, on or before February 1 of each year, a report of the work performed by the departments which the Borough Manager supervises, with a detailed statement of all monies received and expended, during the preceding fiscal year.
C. 
Attendance at meetings. The Borough Manager shall attend all meetings of Borough Council and make such reports and recommendations to Council as are required in this article and as the Borough Manager shall deem expedient.
D. 
Purchases and expenditures. The Borough Manager shall act as purchasing agent for the Borough.
(1) 
The Borough Manager shall have full power to approve all purchase orders in amounts of less than $10,500 for those departments of the Borough over which the Borough Manager has supervision.

(2) 
The Borough Manager shall have full power to pay any and all authorized expenses incurred by the Borough without prior authorization of Borough Council to do so; provided, however, that all such expenditures shall be subsequently ratified by Borough Council at its next regularly scheduled Council meeting.
E. 
Fiscal management. The Borough Manager shall assist and cooperate with the Borough Treasurer in the investment of excess operating funds of the Borough in certificates of deposit or like funds of banking institutions so as to achieve the maximum income to the Borough consistent with sound and prudent investment practices and in the prompt reporting of each such investment, in writing, to the Chairman of the Finance Committee of the Borough.
F. 
Cooperation with Council. The Borough Manager shall cooperate with Borough Council at all times and in all matters in order that the best interests of the Borough and the general public may be served.
G. 
Other duties. The Borough Manager shall perform such other duties as Borough Council, from time to time, by ordinance, delegate to the Borough Manager.
Borough Council shall establish a reasonable compensation for the Borough Manager.
