A. 
The annual fee for an automatic amusement device licensed under MGL, c. 140, § 177A, or any renewal thereof, shall be as set forth in Chapter 174, Fees.[1]

B. 
The License Board may waive the annual fee for any automatic amusement device(s) licensed under this article if the following conditions are met:
(1) 
The device(s) are owned and operated by a nonprofit agency or organization;
(2) 
The device(s) are to be used for recreational purposes in a supervised area, by an identified group (youth, senior citizens, people with disabilities, etc.) served by the organization;

(3) 
The profit realized from such device(s) will be used to fund the activities of the organization.
