There shall be an office of the Public Works Director and an office of Deputy Public Works Director. The Public Works Director shall be a person qualified by education, training and experience to perform the duties of his or her office. He or she shall devote his or her entire time to the duties of his or her office and hold no other office nor engage in any other employment. He or she shall be under the direct supervision of the Borough Council.
The Deputy Public Works Director shall perform such functions as the Borough Council from time to time assigns him or her. He or she shall be under the immediate supervision of the Public Works Director and, where so designated by the Borough Council, shall be Acting Director during the absence or disability of the Director.
The Public Works Director and Deputy Public Works Director shall be appointed by the Borough Council and shall serve at the pleasure of the Borough Council, except a person holding office as full-time Public Works Director or full-time Deputy Public Works Director, who has held that office continuously for five years or more or who has performed the duties of Public Works Director or Deputy Public Works Director under any prior ordinance shall, subject to § 49-20, continue to hold that office, notwithstanding that he or she is serving for a fixed term, during good behavior and efficiency, and shall not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Municipal Clerk and after a public fair and impartial hearing. Any such person may be retired when he or she shall have attained 70 years of age.
No Public Works Director or Deputy Public Works Director shall obtain or be granted any rights of tenure under § 49-19 unless he or she meets the qualifications set forth therein and the Borough Council passes an ordinance authorizing that tenure be granted to him or her.
The Department of Public Works, through the Public Works Director, shall take charge of and be responsible for the construction, operation and maintenance of all public buildings, grounds, streets, roads and other facilities, including general administrative responsibilities for the Borough water system, the cutting of brush, mowing of grass and removal of snow, the cleaning of ditches and the care of other public works in the Borough, subject to the orders and directions of the Borough Council.
The Public Works Director shall:
A. 
Set up and maintain adequate inventory and control thereof of all materials and supplies needed for the maintenance and repair of all public works under his or her supervision and submit inventory annually.[1]

B. 
Submit to the Borough Council a quarterly report of all work performed, services furnished and inspections made during the previous quarter.[2]

C. 
Submit to the Borough Council and the Borough Engineer his or her recommendations for budget appropriations for the ensuing year.
D. 
Recommend for approval the expenditure of all funds by voucher chargeable against the public works budget.
E. 
Inspect or be responsible for the inspection of all storm sewer lines in the Borough individually or in conjunction with other designated officials.
F. 
Receive and investigate all complaints from residents and tax payers of the Borough relating to the operations under his or her jurisdiction, take appropriate action and report results to the Borough Council.
G. 
Attend Borough Council meetings at the pleasure of the Borough Council and meetings of the Public Works Committee.
H. 
Supervise the operation, maintenance and repair of municipally owned equipment used in the performance of the work assigned to him or her.
I. 
Set up, keep and maintain all the necessary books, records, field notes, maps, surveys and similar records necessary to perform the duties of his or her office and turn over all such records to his or her successor or the Borough Council on the termination of his or her employment by the Borough.
J. 
Recommend to the appropriate Committee Chairman the need for repairs and replacements to municipally owned equipment, structures, buildings and grounds.
K. 
Supervise the performance of the work of personnel assigned to his or her jurisdiction.
The Borough Council shall, by resolution, make rules and regulations necessary for the proper regulation of the Department of Public Works and, when they are adopted by the Borough Council, they shall be known as the "Rules and Regulations for the Governing of the Department of Public Works" and shall be binding on each member of the Department.
